Caution: Your Copyright is at Risk

Earlier today I was notified that my image "Depth and Color" was being displayed on a site that does not have permission to do so! I quickly went to the site to see for myself and there it was! It was uploaded by a member of the site that is no longer active, but the damage has already been done!

The name of the site is Wallpaper Abyss and is located here >>…

There are lots of images on this site that I feel are being "S T O L E N !!!"

It is my intention to pursue this fully and with the intent to get the site shut down permanently ! I could use your help in this matter!

Here is the webmaster's contact email address:

I did email him myself and stated that the image was copyrighted to me and should be removed "Today!"

Mr. David West responded to my email and his response follows:

Hello Ricky,

Thanks for emailing me about the wallpaper. I've had it removed. A checksum of that file has also been put in our database, so if that exact file pops up again it will be removed automatically. We encourage users to submit the author with wallpapers, and even let authors pages have links to their other profiles, such as their DeviantArt profiles. I know it's frustrating finding your own work in places without proper attribution, and I'm sorry that it happened on my website.

I would also encourage you to modify your copyright notification you post with each image you submit! You should make it clear to everyone how you feel about copyright infringement!

It is a real pain to have to deal with these kinds of people. I had over a dozen images that had been hijacked and up on a site called Desktop Nexus.

I started looking through their pages of fractal images and I spent over 4 hours notifying the artists here.

It is a good thing that our artwork is like a signature. I couldn't begin to tell how many images had been stolen from here, but I had only gone through 40 pages out of I think over a thousand pages.

I did a journal entry about it so other artists could check it out if they felt like it.

What really infuriated me was that I had to prove that the image was mine, on every image that had been ripped off. One of mine was from 2006. Any "art site" that allows people to post someone else art without permission, should be shut down. I think it encourages art theft if people are allowed to let anyone post any art they happen to find. Of course, the powers that be would do nothing about it. I won't go in to that here. :pissedoff:

There is a great little site that is free where the site will digitally mark your art. What I have done is create the art, upload it here, or where ever you want to, then upload that image to their site and they will copyright it and give you all these numbers. It is so cool.

i would like to point out you have a "standard" copyright even if you dont explicitely tell it on each deviations. so people are always doing something "illegal" if they repost it without permission. though most of the time nothing is done about it and people dont know this fact...

Thanx for the heads up! But it depends on the manner how one post his/her work here on DA. I, for example, post my work with CC "Some rights reserved." option. So I know that my work can (and will) show up on sites like you mention. The story of course changes if you use the full CC option like you do.
But have to agree with others: this site is just a normal sharing site like so so many around.
This one is even 1 of the better ones because the site admin does listen ... he even did alter the lines on the bottom of his site after my suggestions: there was a line just saying something about copyright by that site. Now it says: "All wallpapers retain their original copyright by author/creator.". And that's why it's always important to signature your things (if that matters to you :) ).

On another note: there is some contradiction in your copyright notice you show. In 1 line it says: "This image is for your personal use on your home or office computer ONLY.". And then the line at the bottom says: "My images are created only by me and DO NOT belong to the public domain.". But as soon as someone does use your image on their home/office PC, it's part of the public domain because it's no longer here on DA and DA alone. I could be wrong but that's how I read it being non-English. And because the internet is ofcourse all over the world (and DA also), I think copyright notes should be very clear. And for example the phrase "Public Domain" is one that is not clear for a lot of people (including maybe me :) ). Just do a search for the definition of Public Domain (for example on Wikipedia [link]) and you will see that is has several definitions.

Coming back to the site you mentioned: it's indeed 1 of the more innocent ones. Also giving the fact that the site admin does remove work right away and does listen to suggestions about copyright.

I agree with Lenord. You've found one site amongst how many others. In the six years I've been here I have seen many of these kind of sites. I have found many of my pieces elsewhere, also, and had to go through the same problems to have it removed. Actually I think you were lucky to have it removed so fast. In my opinion there is nothing we can do that we are not already doing. That is, to pass the word along if we see someone's work that you recognize, like we are doing now. I guess you can consider it a compliment that your work was deemed good enough to post on some ambiguous site. Better than on some site trying to make money off of your works. Unfortunately, like Lenord says, there is nothing you can do about it. Copyrights are good, I do it myself, but they are only made for honest people. The dishonest ones just don't give a shi*. It's a drag when you find a new one. When I find something I recognize I do what your friend did, I tell the person. I've done it many times with certain artists here. This is our community, we stick together, most of the time. I will always support any endeavors to stop art theft and am a staunch supporter of anti-pirating efforts. When it happened to me the first time I started checking out all kinds of copyrighting places. That's why all my images have an imbedded watermark and are copyrighted at MyFreeCopyright. I went a little overboard but they have already come in handy in having my works removed from those kinds of sites. Ultimately the choice is to the artist, it IS never-ending. Ciao Rick.

I agree with everyone here in that it is a never ending issue, but Thanks to you this particular issue was brought to my attention and has generated a nice discussion of the Copyright dilemma.

When it is all said and done, you have to expect it to happen. After all as Artist, we create to share!

I have used but find it inconvenient to do for every image! But it is the price you have to pay for your protection is suppose.

It will never Stop, anything, any word any image posted on the Internet can and will be taken by whomever wants it no matter what type, amount or Obvious the Copyright notice is or even the threat of Lawsuit or Great amounts Bodily Harm that will be inflicted if it is Violated. It's going to happen, for every one of yours you find elsewhere there is 50 more you know nothing of, it's Neverending.

In my experience this is an ongoing issue.
In some cases it's just ignorance - first of all of what "copyright" actually means and secondly that images that aren't marked as such are still legally copyright to the owner *and* sites like DA Renderosity etc. *all* stipulate that the copyright of works on their sites remains the property of the original owner. In other cases it's downright selfish self-aggrandisement - ie. foks giving the impression they've created great work that in fact is someone else's and in the worst cases of all of course work is actually in effect "stolen" as they're actually making money out of it.
As others have said - consider it free advertising and assuming it's not being used/displayed in a derogatory context also considfer it a compliment :)
Other than that *always* ask those who've done this without permission to remove the work and if not then inform whoever hosts their uploads that they are in breach of copyright.
To those who would like to post other's work on the web (e.g. as a collection of examples of fractals or manga or whatever) *just ask* the original artist and provided you give say a link back and accreditation I'd guess that 99% of folks will say OK.

Get use to it all.... I've been showing artwork on the net since mid 90's...
Consider it free advertising - at best...
not worth pulling your hair out -- or letting it get gray...

Good to hear he responded. I had a quick glance and offhand didn't see any of mine but I rarely upload in resolutions that are "wallpaper-friendly" or without titles/borders in the hopes it will discourage download cheaters! I did find "frozen in time" on someone's blog one time, shared to Google+, but they linked back to my page so I thanked them for the publicity.

This - however - very uncool. I hate to think how many of those pieces originated on DA and the artist likely has no idea.

Saw a lot of (what looks like) Bryce and Apo works in particular.....
