It is often overlooked that when gathering all the information,

Three and a half year ago, the XPS developer asked CDPR for permission:
- to write a tool to extract the assets from TW3 for XPS and share it with the XPS community
- to port the TW3 assets to XPS and share it with the XPS community
- to modify the TW3 character and share it with the XPS community
- to grant the same rights to the whole XPS community
Three year ago, CD PROJEKT RED given their approval to do it, as long as this use is limited to non-commercial (free) purpose only.
This is one of the most generous permission documents which the community has ever get. Please read it.
Since that time, some porter like MoogleOutFitters thePWA and XNAaraL had port the characters to XPS, according the rule, for free.
But some like Marcelievsky think the rules do not apply to them.
He has not even portet the TW3 character himself. He has used the port of others who have provided the port of the model for free. He used the work of other porters to make money with it.
That's not fair.
- Not fair to the person who pay for this "service".
- Not fair to the porters.
- Not fair (and not allowed) to CDPR: "You have (had) the approval to modify these character models and release the modified models to non-commercial (free) purpose only."
- Not fair to the person who had asked for permission for all to release these models for free.
- Not fair to the whole XPS community
How did it end, if porters breaks the rules?
- XPS got a strike.
- CDPR revoked her approval to use there assets for XPS
- the latest TW3 patch broke the extract and it's impossible to uncook the files correctly
- It is no longer allowed to spread a corrected tool
- porters like MoogleOutFitters, thePWA, XNAaraL, Verahnika, X-N-A and many others has stopped to port models for XPS

- No more new XPS versions

Just in case you want to know WHY all the ports, meshmods, comic, fanart and updates gone here once for all. I wish you thank all these splendid, selfish and money addicted guys like Marcelievsky for there purely egoistic reactionary behavior against the whole community.
These rule breakers do nothing good for the XPS community. This rule breakers destroy everything!
And the community stay inactive as some destroy everything.

Well, if you're teen or around 20' and you have some hope of decency in mankind, you have an heart, but if you're around 30' and you still have faith in mankind, then you have no brains. So either the CDK are fools, or i guess they should have expected some such. Seriously, what there's to be so amazed i don't get it.

Here? Do you mean on the XPS or the cdk matter? I don't think someone of us could do something. Do not misunderstand, i definitely do not approve those behaviors, and i've always disliked people who would lower themselves to do anything for just those few coins more. I'm just saying that there's nothing we can do, other than aknowledge the fact that that's mankind. Of course, if i could handle the matter on my personal way, you could bet i would solve the problem. Alas, it's not considered actually legal too.

+ The right way: "Fight for our own cause." ... Post your opinion if you not approve those behaviors ... flame / ignore the evils ... Show us how you disliked people who would lower themselves to do anything for just those few coins more.
Of course, if i could handle the matter on my personal way, you could bet i would solve the problem.
Many of my opponents use my programs. They don't know that my programs are allowed to do the same on their computers as they can do.

Alas, not everything is considered actually legal too. 
Well.... You're right of course. But what can i say, after you see pricks like these folks doing things like that almost every day you lose the will of express your disgust each time. But yeah, at least state it maybe would do something good, i don't know. Honestly i really don't think they would give the slightest damn until someone pursue them legally.... Or worse.
In the end who lose out is people like us, which is not petty and doesn't see the symbol fo dollar in EVERY thing that pass in front of us.

In the permission document, there is no "freedom to modify TW3 character for money", neither as Commission nor as any payment service or to sell it. It is clearly strictly forbidden.
The introductory words equate "for free" with "non-commercial".
This is in my opinion misleading.
CDPR requires non-commercial.
The term "Free" suggests something else.
The term "free" is a matter of liberty, not price. To understand the concept, you should think of "free" as in "free speech", not as in "free beer".
Being free to do things means (among other things) that you do not have to ask or pay for permission, and even have the freedom to sell it.
Please bear in mind, that CDPR, the copyright owner of TW3, do not granted this right.
The use of there assets is for "non-commercial" use and not for "free" use.
We have not the freedom or liberty to use the models from "TW3" for more than what is included in there permission document.
If something would has really a "Royalty-free licence" you should also have the freedom to publish your changes for any purposes. You should not be required to notify anyone in particular, or in any particular way. You should not be required to communicate about it with any other specific entity.
Free does not mean non-commercial. A free asset must be available for commercial use, commercial development, and commercial distribution. A non-commercial intellectual property is what it is: A property asset with a non-commercial licence and not intended for or directed towards commercial advantage, or monetary compensation. (The definition is intent-based and intentionally flexible in recognition of the many possible factual situations and business models, like *Commission*, that may exist now or develop later.)
To gain money with copyrighted assets is in fact affecting not only the copyright holder, but also anyone else who truly wants to enjoy XPS, to make renders, to use the ports for study it, or to adapt it to his needs.

Okay, I honestly didn't know XPS got a strike... nor that CDPR revoked permission and basically locked all content because of the way people were using their assets. If that's the case, then the situation is even worse than I thought, because this proves what people do to gain money with copyrighted assets is in fact affecting not only us, but also anyone else who truly wants to enjoy XPS and use the in-game ports for study (may it be for modeling purposes or just cosplay references). I am not specifically talking about Marcel here though, so many people are profiting from in-game assets with commissions and on Patreon. This won't stop unless other companies start striking them as CDPR did.

All model descriptions CLEARLY state they are not to be used for profit and that the models would be removed if someone did, so don't say you weren't warned.
Yeah, the majority of porters who were once active in the porting community are now either gone or just done with the sharing habit.
