Group Rules

Participation in the ThoseWhoWentMissing game requires that you agree to these rules, if you violate these rules you may have certain permissions revoked and you could be blocked from esk ownership or future events and activities. Multiple offenses can lead to being banned from all participation in the game. These rules are in place in order to make the game structure function properly, if you have a question or concern about the rules you may send in a group note or contact witherlings directly.

    Green arrows Using your esk in the game

    • You may only use esk that you own.

    • Esk are a closed species created by witherlings and can only be obtained by earning them in the TWWM game, receiving them from owners by sale/trade/gift, or by purchasing directly from witherlings or approved guest artists. Creating esk characters without permission is not permitted.

    • You are responsible for accurately and honestly tracking your character's Growth Points. Please request assistance if you need help.

    • Please read the Ownership Transfer Rules before attempting to buy, sell, trade, request, or give away any esk characters. These rules are in place to help maintain fair use of the adoptable market and keep the game accessible. If you are uncertain of the rules it is always best to be cautious and send a group note to confirm a transfer before any money/assets are exchanged. 

    • Submitting artwork of an esk MYO that has not yet been approved (via Transformation or otherwise) or with unapproved modifications is not part of fair gameplay and these submissions will be removed and do not receive points. The MYOs you earn in the game should be used within the game framework and should not be modified or created without earning them in the game — without this limitation the game will not function effectively for everyone.

      For this reason, please do not make design changes to your free MYOs without explicit permission from witherlings.
      Game-earned MYOs are intended to be used within the TWWM canon and game structure so we can all work together on a shared, collaborative story. More information on editing adoptables is outlined below.

    • New Growth Button by dualsceptersYou are not permitted to participate in the game with multiple accounts. Every player may only use one account to gain esk and use them in the game. The use of multiple accounts, especially to gain advantages, for example in the Nursery or Greenhouse game features, will result in a strike. If you would like to move your progress to another account that you own, please send a note to the group from both accounts to confirm the change. Your esks ownership will then be updated. The use of a side account (such as an account you use specifically to share ARPG related artwork) is permitted, as long as this is the only account you use to participate in the game with.
    • New Growth Button by dualscepters If you wish to remove an esk from play to change them into an OC (Original Character), please send a note to the group beforehand. Any Esk that is removed from play needs to have significant changes made to the design so that it may not be mistaken as an Esk character. Esk bought through Guest Artist and Staff Artist Sales will require the permission of the original creator of the esk before they can be removed from gameplay, unless otherwise stated in the respective sale ToS. Esk gained through official free raffles held by the group will require the permission of the original creator of the esk before they can be removed from gameplay, unless otherwise stated in the respective raffle rules. Esk that were created through MYO Slots by other players that you obtained through a trade, will require the permission of the original creator of the esk before they can be removed from gameplay. Esk that you have created through MYO slots, like transformations or wellsprings wishes, yourself and that you own, may be removed from play at any time and made into an OC after confirming with staff. Esk that have been removed from play may never return to be an Esk again.

    • Obtaining an adoptable does not automatically grant you copyright of the image, copyright always remains with the artist. If you purchase an adoptable you are purchasing the rights to use the concept and image for personal use only. Commercial use or redistribution is not allowed.

    • When you obtain a MYO for free in the game the artist always retains copyright of the design image unless explicitly stated otherwise by the artist. If an artist makes a masterlist or reference image for you it does not automatically grant you copyright of the image, it only grants you the right to personal use of the image. If you are ever unsure about fair image use always contact the original artist for details on their policies.

    • Adoptables are allowed to be resold as long as they follow the guidelines below. The sale/transfer will include the rights to personal use of the adoptable's masterlist or reference image unless explicitly stated otherwise by the artist. Rights to use of the reference image after an adoptable's ownership is transferred is a permission that has been granted to the new adoptable owner by the image copyright holder and does not constitute full ownership of the copyright or intellectual/conceptual property.

    • You cannot claim ownership or copyright of a plant or other nature feature — multiple people can have esk with the same types of nature features on them. If you are concerned that design similarities have crossed into character theft please send TWWM a group note to discuss.

    • You cannot design MYOs based on any copyrighted characters or trademarked designs other than designs that you created yourself (existing OCs, etc). Accidentally designing a character that bears too much resemblance to existing characters that you do not own will need to be revised before approval.

    • Art theft in any form will not be tolerated and is a serious offense.

    • New Growth Button by dualsceptersPhotographic elements (matte painting, photobashing, etc) and other photomanipulation are allowed in TWWM as long as the photographer's rights and ownership of images are honored and respected. You may use photographs that you have taken yourself, use photographs that are under a Creative Commons (CC) license (click here for more information about CC licenses), or photos that have other free use licensing (ex: Unsplash). If you are ever unsure about whether a photo found online can be used freely, please contact the resource's website or the photographer for more information or for direct permission to use the image. Any time you incorporate a photograph into your image, you will need to provide credit to the original photographer by linking to the source it was obtained from. This rule applies to any artwork where photographs are intact (ex: unaltered or only changed with a filter) or manipulated (ex: directly drawn or painted over). While some photographers or free photo websites do not legally require credit or attribution, at TWWM we want to support other creators by including credit for their original work when it is used in our community. We also request that you credit yourself when using your own original photos, both for clarity and because that deserves recognition too! Failure to provide credit may cause delays in the submission review process. Please be aware that TWWM's definitions of fair use may sometimes differ from legal definitions. In order to maintain the points system and a consistent gameplay experience, we have to set additional rules when it comes to having photo-derived artwork qualify for prompts, events, or scoring. Please send a group note for advice if you are uncertain about whether your photo use fits into the gameplay and scoring systems.
      The above rules also apply to tracing. Using photographs for reference does not require credit, though it is still encouraged in the spirit of recognizing others' work.

    • witherlings species guide artwork can be heavily referenced or used as a base when creating MYO designs. There are also free bases in the Resources gallery. Do not use other artwork as a base without explicit permission from the artist.

    Green arrows Community Rules - Code of Conduct

    • Please help us maintain a calm, safe, and respectful atmosphere for all players here at ThoseWhoWentMissing. Harassment and hostile behavior will not be tolerated within this group and moderators will intervene if there is abuse within the group. Begging or being overly aggressive when it comes to free art/writing/activities is considered inappropriate behavior and will result in a warning or strike.

    • You must be 13 or older to participate in ThoseWhoWentMissing (applies to both the DeviantArt group and the Discord server).

    •   TWWM is a LGBTQA+ safe space. Homophobia will not be tolerated in our community. Violation of this rule can result in a ban. This is a non-discriminatory environment and we take this issue very seriously.

    • This is not an appropriate venue for discussions about politics or religion. Please take these topics elsewhere.

    •  Please exercise caution when bringing up topics related to money/finances and be respectful of game members that are participating in the adoptable or art/commissions market within our community. Criticism of what people buy/sell or how much they spend/charge is inappropriate.  

    • Please respect the artwork, writing, and stories of other players. If you are unsure if another player would be happy with your depictions or interpretations of their characters, always ask them first.

    • Violence/gore and horror themes are acceptable in artwork and stories, but other forms of NSFW artwork are not permitted. Please mark NSFW artwork accordingly.

    • The Wandering-Esk account is occasionally used for moderator actions and includes a list of warnings/strikes information. We follow a three-strike policy for most offenses.
    • New Growth Button by dualscepters We ask that players refrain from "mini-modding" within any part of TWWM. This includes, but is not limited to, speaking as an authority without being a member of staff and asking about or replying to official inquiries of other players (e.g. Energy Exchange, Transformations, Nursery and the Greenhouse). Design questions, unless posted in #Plottinggrounds or another appropriate channel on Discord, should be left for staff to answer. Furthermore, only staff members may answer questions in the #Askstaff channel on Discord. Players are allowed and encouraged to answer simple gameplay questions of other members, but should do so in a polite and respectful way. Gentle rule reminders are also allowed, but rule breaking should always be reported to a member from the Outreach team.
    • New Growth Button by dualsceptersPlease keep comments in all official areas on topic and refrain from leaving comments on inquiries or requests that are not your own. Official areas include, but are not limited to, the nursery, the greenhouse, the transformation and the energy exchange journals. While commenting to claim or to ask questions relative to the specific journal is always ok, leaving suggestions, replying to someone else's claim, or adding commentary to their design approval is not allowed. If you have a suggestion, please refer to our Suggestion Box. Leaving comments on official journals can lead to confusion and unnecessarily clutter them, making them harder for players and staff to use and view.

    Green arrows Sensitive material

    • While mature themes are permitted in the group, we ask that graphic, explicit material  be kept outside of the TWWM group. You can create your own original stories and earn points for submissions with some of this subject matter, but in order to maintain a safe gallery space we need to ask that submissions that explicitly show the acts of self-harm, suicide, or drug overdose are logged in your own galleries or off-site without being submitted to the group. We also ask that all sensitive material created for TWWM is labeled with a warning in the title/link and description of the image, even if you will not be submitting it to the group gallery. If you are posting sensitive material and are unsure if this applies to you please send us a group note for advice, or when in doubt you can just take a cautious approach by keeping it in your logs without submitting to TWWM. Explicit work can be logged directly in your character trackers and player profile, but the pieces should be under a clearly labelled link rather than a thumbnail.

      Violence and horror themes are acceptable in artwork and stories, but other forms of NSFW artwork are not permitted. Please mark NSFW artwork accordingly.

      For example, character death in general is not banned from the group gallery. In most cases it would be allowed so long as it has the appropriate mature filter and warning. This rule comes into play for pieces that are exceptionally graphic or could be considered distressing to the majority of players. Only a handful of art pieces fall into this category – generally 'dark' backstories are still allowed as they always were.

    Green arrows Journal and Advertisement Submissions

    • All journals submitted to the group must feature the esk species as a main subject — anything unrelated to the game will not be accepted.

    • Please review all of the ownership transfer rules before posting ads involving sales and trades.

    • Submit your journals to the appropriate folders:

        • Trading journals involving trading, swapping, or reselling esk should go in the Esk Trades + Sales folder.
        • Journals that are seeking esk should go in the Seeking Esk folder.
        • Art-related journals (that do not involve trades regarding esk) should go in the Advertisements folder.
        • Journals that do not pertain to trading esk or esk artwork belong in the Activities + RP Postings folder; this can include livestreams, seeking relationships, RP journals and other esk related activities.

    • You are not allowed to trade character mods, points, or anything that is not related to the ThoseWhoWentMissing world.

    • Closed journals will be periodically cleared out, if you would like to re-add a journal that has been removed from the ThoseWhoWentMissing group, please resubmit it.

    • Please refrain from resubmitting or 'bumping' active journals and visual advertisements until 1 week past the initial submission date.

    • Journals older then 2+ weeks will be removed from the group if we find them inactive, please help keep the folders clean by deleting or removing inactive or closed journals from the group.

    • You are not allowed to post ownership transfer advertisements before the cooldown period has ended. This makes enforcement of the cooldown more complicated for the TWWM team to monitor, thank you for respecting this guideline.

    Green arrows Points

    • You cannot sell, trade, or give away Growth Points or Aura Points. 

    • You cannot take Growth Points from one character and transfer them to another character or take Aura Points from one player and transfer them to another player.

    • You cannot trade in points for traits/features in the Energy Exchange for any character other than the one doing the trade. You cannot "buy" things for another player's characters or use one of your esk to buy things for your other esk.

    • Growth Points are included in all ownership transfers.

    Green arrows Point Farming

    • "Point farming" does not reflect the integrity of this game and is not allowed in this group. If your work reflects an obvious intention to rapidly raise large sums of GP/AP with no regard for quality or subject matter then it will be removed from our galleries and not count toward your score. Hiding artwork of this nature in your sta.sh or off-site is not allowed, if staff cannot access the artwork then it cannot count toward your score.

    • Examples of point farming:

      • Large amounts of repetitive artworks with very slight variations in each piece. This may include YCHs if the artwork has not been changed enough to constitute a new artwork. Copy-pasting elements and rescoring them is not permitted.
      • Large amounts of rough sketches or doodles submitted together or separately, or sketches/doodles that have been overscored as fully shaded artwork.
      • Large amounts of base recolors or YCH "sheets" intended for mass production.
      • "Floating head" compilations of many simple headshots with very slight variations in each headshot (in these cases the intention to farm points should be obvious).
      • This list is not comprehensive, submissions suspected of point farming will be evaluated on a case-by-case basis.

    • ThoseWhoWentMissing's gameplay revolves around creative character design, world-building, and storytelling. Mass produced artwork directly contradicts our mission and we will continue to reward players who challenge themselves creatively and make generous contributions to the game and community.

     

    Green arrows Raffles

    • Players are allowed to raffle off adoptables, Transformation MYOs, or free artwork/writing as long as there is no entry fee required for participation. Raffles cannot involve money in any way.

    • Players can otherwise set their own rules for the raffle by giving extra tickets for gifting others, granting Wellsprings wishes, or other altruistic activities.

    • Players are allowed to aim their raffles exclusively to first-time-owners or for a certain player level.

    • Requiring players to make artwork for you in order to receive tickets is not permitted, raffles should be done with a spirit of generosity and community-building and not for personal gain.

    • Please help us keep TWWM accessible by having free MYOs remain free and accessible for all players.





Ownership Transfer Rules

You are responsible for reading these rules before doing any ownership transfers for any esk adoptables. This includes all sales, trades, and gifts. When you obtain an esk adoptable you must agree to these terms — we must work together to maintain a fair and accessible community at ThoseWhoWentMissing, thank you for helping us in this mission.

Violations of these ownership rules may result in warnings/strikes on your account. It is always best to send us a group note if you are unsure if a transfer is fair, this way we can help you avoid any potential conflicts with the rules or in your exchanges. It is much easier for us to help you before an exchange has taken place rather than afterwards.

New Growth Button by dualsceptersWhen making an ownership transfer, the current owner of the esk must specify what type of transfer it is (trade, swap, sale, or gift) in the transfer comment.

If it is a swap: state the ID of the esk you are swapping with
If it is a trade on an esk that has "❌ cannot trade (non-esk)" listed: state if you are trading for a TF slot or art. You do not need to link to the TF comment or artwork done (though you can for extra-safe records).
If there is a three-way (or more) transfer: state the exact transfer (i.e. player 1 -> player 2 -(TF)> player 3 -> player 1)

 MYOs can now be traded for original artwork!

This change to the ownership transfer rules will allow any players that are leaving the game to be able to receive something in exchange for their earned esk characters and give new players without an esk to swap the option of gaining an esk by trading artwork. In order to maintain our efforts to keep MYO exchanges free we ask that artwork used for esk swaps be original artwork only that you create yourself and not be commissioned/purchased with money from other artists. This will also help our masterlist staff have an easier time reviewing exchanges since they will only be between two people instead of three or more. Original artwork must be a new creation for the purpose of swapping, and does not include custom adoptable/character designs (artwork must be depicting existing characters, not the creation of a new character). Crafts, writing, and other creative works will also be considered; please send staff a group note if you want to make sure your swap will be approved. 

Please help the masterlist staff verify these types of ownership transfers by providing links to the traded artwork when requesting the ownership transfer. TWWM-related artwork used in esk swaps must follow all of the other TWWM Group Rules, including rules against point farming. Non-TWWM artwork is also allowed for swaps and does not need to follow TWWM group rules.

    • Can sell at any price, can trade for anything, can give away.
    • Two weeks must pass between ownership transfers.
    • If assets individually would be allowed for an exchange, then you are also free to bundle them together when making an offer.

    • One month must pass between the original purchase and the first resale. After that the standard two week cool down applies.

    • Cannot be sold. Can only be gifted or traded for other esk characters or transformation slots.
    • Two weeks must pass between ownership transfers.

    • Premade and custom prizes can be resold, can be traded, can be given away.

    • If assets individually would be allowed for an exchange, then you are also free to bundle them together when making an offer.

    This ONLY applies to esk created from MYO slots purchased directly from witherlings
    • Can resell at the original price (or lower), can trade for anything, can give away.
    • Two weeks must pass between ownership transfers.
    • If you decide you do not want your MYO anymore please consider gifting it to other players. Since the game was created all new MYOs are earned in the game for free and not used for gain of money/assets, we appreciate it if you continue in this spirit of generosity by treating purchased MYOs the same as the free ones earned in the game.
    • Purchased MYOs are the ONLY MYOs that can be sold or traded for non-esk adoptables. MYOs earned for free in the game have different rules (see below).


    Green arrows Purchased MYO Slots (not yet designed) 

    This ONLY applies to MYO slots purchased directly from witherlings
    • Can resell at the original price (or lower), can trade for anything, can give away.
    • If you decide you do not want your MYO anymore please consider gifting it to other players. Since the game was created all new MYOs are earned in the game for free and not used for gain of money/assets, we appreciate it if you continue in this spirit of generosity by treating purchased MYOs the same as the free ones earned in the game.
    • No time restrictions on ownership transfers.
    • Purchased MYOs are the ONLY MYOs that can be sold or traded for non-esk adoptables. MYOs earned for free in the game have different rules (see below).


    Green arrows MYO adoptables earned in the game

    This applies to esk created from Transformations or won as game prizes, including esk obtained via the Wellsprings. It does not apply to Transformation MYO slots that are not yet designed.
    • CANNOT SELL, can only trade for other esk characters, original artwork, or Transformation MYO slots, and can give away.
    • You cannot attach money or other assets like non-TWWM adopts/characters in a trade (including custom designs) — it must be esk-for-esk only, or esk-for-original-art only.
    • Two weeks must pass between ownership transfers.
    • 3-way trades involving non-esk characters, bartering, or money are not permitted.
    • "Gift for gift" exchanges count as trading! 
    • Please help keep these MYOs free for everyone by not attempting to sell or trade them outside of the game.

    Green arrows Starter MYO Adoptables

    This applies to esk created from MYO slots obtained through the Nursery
    • CANNOT SELL, can only trade for other esk characters, original artwork, or Transformation MYO slots, and can give away.
    • You cannot attach money or other assets like non-TWWM adopts/characters in a trade (including custom designs) — it must be esk-for-esk only, or esk-for-original-art only.
    • Two weeks must pass between ownership transfers.
    • You cannot give an undesigned Starter MYO slot to anyone under any circumstances — if you no longer want it you must comment on the Nursery to cancel your Starter claim. You will then be available to claim a new one from a future Nursery list.
    • 3-way trades involving non-esk characters, bartering, or money are not permitted.
    • "Gift for gift" exchanges count as trading! 
    • Please help keep these MYOs free for everyone by not attempting to sell or trade them!


    Green arrows Greenhouse MYO Adoptables

    This applies to esk created from MYO slots obtained through the Greenhouse
    • CANNOT SELL, can only trade for other esk characters, original artwork, or Transformation MYO slots, and can give away.
    • You cannot attach money or other assets like non-TWWM adopts/characters in a trade (including custom designs) — it must be esk-for-esk only, or esk-for-original-art only.
    • Two weeks must pass between ownership transfers.
    • After claiming a Story MYO you must wait for 4 new lists to come out before you are eligible to claim again.
    • You cannot give an undesigned Greenhouse MYO slot to anyone under any circumstances — if you no longer want it you must comment on the Greenhouse to cancel your Story MYO claim. You will then be available to claim a new one from a future Greenhouse list.
    • 3-way trades involving non-esk characters, bartering, or money are not permitted.
    • "Gift for gift" exchanges count as trading! 
    • Please help keep these MYOs free for everyone by not attempting to sell or trade them!


    Green arrows Transformation MYO slots (not yet designed) earned in the game

    This applies to MYO slots that are generated by redeeming Transformations, as well as MYO slots obtained via the Wellsprings.
    • CANNOT SELL, can only swap for other Transformation MYO slots or for existing esk characters.
    • If swapping for existing esk you must follow the other guidelines on this page. Please respect cooldown periods.
    • You cannot attach money or non-esk assets to Transformation MYO swaps, game-earned MYOs are intended to be free for everyone and this offense is taken very seriously.
    • You can only offer to swap Transformation MYOs that you are prepared to execute, you must have the AP and GP requirements ready at the time of the swap.
    • Transformation slots are bound to you, the player. Your esk will preform the transformation. Swapping transformation slots means that your esk will preform a transformation for another player, and that players esk will preform one for you. You cannot give your transformation slot to an esk that does not belongs to you and have them preform the transformation.
    • Once the MYO is designed it falls under the "MYO adoptables" category and follows those rules.
    • 3-way trades involving non-esk characters, bartering, or money are not permitted.
    • "Gift for gift" exchanges count as trading! 
    • Please help keep these MYOs free for everyone by not attempting to sell or trade them!

    **Transformation slots (MYO not yet designed) are not affected by the new art-for-MYO trading rules. **


** All changes in ownership MUST be reported to the Esk-Masterlist in order for permissions to be valid! **







Adoptable Terms of Service

By purchasing or otherwise obtaining an adoptable from witherlings or official guest artists you are agreeing to these terms.

Having ownership of any adoptables related to esk or the ThoseWhoWentMissing game (TWWM) requires that you agree to these terms of service, if you violate these rules you may receive warnings or strikes on your account. See Wandering-Esk for more information on the strike system.



What is an adoptable?

Adoptables are characters you can collect for personal use. When you buy or earn an adoptable character, you are receiving partial rights to the design and concept in order to use it for your own creative works and representations. Adoptables can also be traded, bought, and sold.
Esk are a "closed species" which means you are not permitted to create your own esk designs or adoptables for any use or purpose without explicit permission from the creator (witherlings) or by earning them in the ThoseWhoWentMissing game.


 The Terms of Service outlined below primarily apply to esk purchased directly from witherlings.

Please read all of the rules on this page if you own an esk or participate in the game! It's a lot of information but it helps the game run smoothly and keeps the community fair for all of its participants.


    Green arrows Using Your Adoptable

    • You are encouraged to create a personality, name, and background for your adoptables. Please respect the concepts and lore behind the designs when developing your characters.

    • You can use the witherlings adoptables in any personal works within the ThoseWhoWentMissing world you like and post it to any of your social media platforms. If posting witherlings artwork please leave their watermark intact, if posting your own TWWM creations please link to ThoseWhoWentMissing or have "thosewhowentmissing.deviantart.com" visibly added to the image.

    • Commercial use of esk and TWWM-related concepts or artwork should be discussed privately with witherlings, do not use TWWM-related material in commercial projects without explicit permission from witherlings 

    • All esk adoptables can be used as characters in the ThoseWhoWentMissing game.

    • Buyers of witherlings adoptables can use them in personal projects unrelated to the game or species lore. Please contact witherlings if you are unsure about fair use or if it involves publication.

    • You are permitted to use a purchased esk design outside of the ThoseWhoWentMissing as a personal character or as a collectible — participation in the game is not a requirement. Any non-canon use or changes to the design will not be considered official, will not be recorded in the masterlist, and will not be usable in the TWWM game. I respect your purchase of the adoptable as a personal character and your wishes to not enter the game. We do not want to be overly restrictive of your creativity and personal stories but still ask that you respect the content by using your purchased character in a manner that is respectful to the creator and not in poor taste.

    • Overall we strongly request abiding by the game rules and only making design changes to purchased adoptables when earned in the game. This is the most fair to everyone, please contact witherlings if you are unsure about fair design changes — I may be able to work with you on making adjustments to purchased adoptables without an additional fee or gameplay required.

    • If the character is a game-earned MYO please keep it within the TWWM world as part of our collaborative gameplay mission and follow the rules of the game by not making design changes without permission from the TWWM team or by earning with points.
      This helps keep the game fair, functional, and collaborative — thank you for respecting this goal.

    • You do not obtain copyright of the image or concept when purchasing an adoptable, the copyright always remains with the artist. Retaining copyright protects the artists intellectual property — it does not mean that the character or artwork will be re-used for other purposes or profits.

    • The partial rights you acquire in your purchase allow you to use the image and concepts for personal, non-commercial use only. The only options for sale/trade are listed in the ownership transfer rules above.

    • You cannot claim ownership of a plant/nature-feature for your esk. Multiple people can have esk with the same type of plant or nature features on them, this does not violate copyright.

    • You may not claim these designs and concepts as your own, always give proper credit to artists and designers.

    • If you are interested in selling prints that involve esk characters or concepts, please contact witherlings with details. 

     

    Green arrows Making Changes to Your Adoptables 

    • When you purchase an esk from witherlings for use in the TWWM game you are allowed to make 2-3 basic edits for no charge, you do not need to use the Energy Exchange for these changes. You cannot make edits that increase the rarity of your design without explicit permission from witherlings. Inappropriate modifications will not be made official.
      Examples of basic changes include: changing an area of markings, making the tail longer or shorter, changing eye-color, etc.

    • Please confirm any edits made to the witherlings adoptable by reporting them to Esk-Masterlist or by requesting a Spirit Renewal - Masterlist Update if you intend to use them in the game.

    • Please make larger edits to witherlings adoptables by participating in the TWWM game! This is part of the gaming incentive and is a reward for using the character you have purchased. If you would like to use the character for personal use only and not participate in the game some larger edits may be allowed, but please contact witherlings to touch base before making any large edits.

    • If you purchase a guest design you are not allowed to make minor or major edits without contacting the artist, we respect the individual wishes of our guest artists and require that you work with them directly on character changes. Otherwise, all changes to guest adoptables should be earned in the TWWM game.

    • witherlings original artwork can be edited directly. If your adoptable was created by a different artist you must obtain permission before editing their artwork.

    • Premade esk adoptables made by witherlings or guest artists come with some predetermined characteristics. Nature, size, traits, and nature features cannot be altered after purchase. 

    • You can only change the Boundary for witherlings or guest adoptables once within the course of your ownership of that esk, whether bought directly from witherlings or obtained from other players by sale/trade/gift. Boundary changes need to be reported on the character's masterlist entry. 

    • Nursery MYOs, Story MYOs, and Transformation MYOs cannot have their ID information changed, including the boundary.

     

    Green arrows Purchasing from witherlings

    • Only USD via Paypal invoice is accepted. Do not send money directly unless specifically requested by witherlings.

    • Quick payment is appreciated but longer waits or payment plans can be discussed as needed. I typically ask for a portion of the payment up front and then allow a month for the remainder to be paid off, but I am very flexible!

    • Ownership of adoptables is not finalized until payment is received in full. You cannot do any form of ownership exchange until the ownership is finalized; masterlist entries will be marked as "not finalized" or "pending" until payment is confirmed.

    • You are allowed to use a purchased witherlings esk in the game only after some or all of the payment has been received. You may not use the character to earn points, submit artwork/writing, or create a character tracker until a deposit or full payment has been made.

    • Failure to complete payment or attempting to transfer ownership without finalizing payment will result in a temporary ban with restrictions on buying/selling/trading activity until buyer is in good standing. Restrictions and ban time are to be determined on a case by case basis. Repeatedly failing to follow this rule will result in a permanent ban from sales and raffles of any kind. This rule also applies to guest artist sales.

    • Refunds or buybacks are to be discussed on a case-by-case basis privately with witherlings

     

    Green arrows Custom Adoptables by Witherlings

    • Custom adoptables are made according to your own specifications. Requests must adhere to the species lore and design properties. 

    • Customs cannot be derivative of other existing characters.

    • Custom adoptable commissioned may be canceled and refunded if there is obstructive lack of communication, inappropriate request, or violation of the Terms of Service.

    • Customs are offered very rarely, there is no guarantee that they will be available at any given time.

    • All rules about customs also apply to custom adoptables that are earned as game prizes.

     

    Green arrows MYO Adoptables

    • "Make your own" (MYO) adoptables are adoptables that are user-created with permission from witherlings. When you purchase an MYO slot you are buying the rights to create your own esk that adheres to the lore and design properties of the species.

    • witherlings is the only person allowed to sell MYO slots. witherlings has no plans to open sales for MYO slots in the future, from now on MYOs are considered a free gift to reward players for participating in the esk world.

    • MYO slots can always be obtained for free by participating in the ThoseWhoWentMissing game.

    • Refunds or buybacks are to be discussed with witherlings on a case-by-case basis.

    • Purchased MYO resale/trading is now allowed as long as it follows the Ownership Transfer Rules outlined above.

    • All MYO designs must be approved by witherlings or the TWWM team and be added to the Esk-Masterlist before they are considered to be official esk. MYO esk cannot be used in the game until they have been added to the masterlist!

    • You cannot add uncommon or rare traits to your MYO design unless you have explicit permission to do so or have earned them in the game.

    • MYO adoptables and transformation slots obtained for free within the game cannot be part of any kind of 3-way trade that includes any assets outside of the TWWM game (characters, money, art, etc). Please help keep free MYOs free for everyone! Thank you for respecting this guideline.

    • "Gift for gift" exchanges still count as trading! Keep this in mind when doing any ownership transfers with MYOs and always follow the ownership transfer rules outlined on this page. Contact the TWWM team by group note if you ever are unsure of fair exchanges.

     

    Green arrows Use of Paypal

    • For an individual to open a U.S. PayPal account and use the PayPal services, you must be a resident of the United States or one of its territories and at least 18 years old, or the age of majority in your state of residence.'
    • This means witherlings will not do business with anyone under the age of 18. Going around this rule by using someone else's account or sharing accounts is also not allowed
    • This applies to official guest artist sales as well.

     

    Green arrows Guest Artists

    • Some artists may receive permission from witherlings to create and/or sell their own esk designs. These terms of use will extend to their designs unless otherwise specified by the artist.

    • Backing out from paying for a design won in a guest artist sale, as well as failing to complete payment plans or attempting to transfer ownership without finalizing payment, will result in a temporary ban with restrictions on buying/selling/trading activity until buyer is in good standing. Restrictions and ban time are to be determined on a case by case basis. Repeatedly failing to follow this rule will result in a permanent ban from sales and raffles of any kind.

Hey!

Esk are a closed species so you can only make one with permission. However, there are many ways to earn make your own esk slots for free!

what constitutes as "using" an esk in the line, "You may only use esk that you own."? ie, if I saw a cool esk and wanted to draw/write about it, is it alright for me to do so without asking the esk's owner/waiting for permission on it? (of course, if they didn't like how their esk was depicted and asked for it to be taken down, I completely understand that)

Small note- only reason I haven't updated this more is because Eclipse made editing journals super wonky, old ones at least. I am trying to think of a way to make this a bit more updated/accessible!

Hello, I wanted some clarification on something related to design changes!


I have a couple of esk here, both of them were designed by me and I was wondering if it's at all possible for me to reuse their designs? For instance, taking the design off of this Esk I made and turning it into a different CS!

Are we allowed to use previous versions of our Esk in Art? I fell in love with the original version of the Esk that I own. I love the new version too but not as much.  Any advice?

Previous forms of your esk may be drawn. You also have the option of reverting back to the esk's original form/art if you prefer that to their current look.
You won't be able to return to the current version they have and the GP that had been spend to make all the changes the esk has, also won't be returned.

There are many opportunities within the group to earn free MYO slots, with which you could create those esk of yours.
Either through reaching a certain player level and unlocking transformations, or perhaps getting lucky in our wellsprings feature where you could wish for a free MYO:

I hope this is the right place to ask, but I had acquired a esk on the 3rd of this month ( when the original owner notified about the trade )
and the ownership was updated on the 8th of this month, does the cool-down period apply from the original owner contacting about the trade or when the actual masterlist is updated?
