You are expected to follow and comply with these rules when you purchase and/or receive adopts and arts from me.
Breaking these rules can lead to you being blocked and/or blacklisted. Failure to read the TOS is not an excuse to break a rule.
Artist and Species Rights
I reserve the copyright and intellectual property of any Closed Species (Parfumimi and Wallflora) created by myself and guest artists.
I reserve the right to use the official art for my Closed Species and designs on my website, portfolios, merchandise, prints, art books, etc.
By purchasing my designs and/or my Closed Species designs, you agree that the design may be used in events, books and other merchandise without interference.
I reserve the right to ban/redistribute ownership of a design and terminate the rights to my species for anyone who breaks the Terms of Service.
Outside of this TOS, this includes, but is not limited to, harassment of any individuals, rude behaviour, scamming and theft.
General
Only accounts older than 3 months are allowed to purchase (designs) from me.*
*Exception: if you can prove you have an older (moved) account that was active and/or if you have a substantial amount of successful purchases from other artists.
Feel free to make any changes to the design afterwards, however not on the original artwork, unless previously discussed with me. Any edits made must be noted.
You do not need to credit me every time for creating the design, but it is preferred if you credit me or the respective guest artist at least once.
You must credit me for the species.
Designs may be purchased as gifts or co-owned, but all parties must agree to my ToS.
You cannot resell for higher than what you bought the adoptable for, with the exception of extra commissioned art that comes with the character.
Trading or gifting the adoptable is fine. Please notify me of any ownership transfer.
You have 48 hours to respond if you have won an adopt; if you do not reply within that time period I will assume you are no longer interested, and the adopt will be placed back up for sale. I would prefer that you reply even if you are no longer interested (with good reason). Your account will be striked or blacklisted if this occurs without a good reason.
Holds are for 48 hours max, with an exception if you have a good track record with me (meaning this is not your first time purchasing a design from me.).
Please save the separate image(s) for your adoptable and art, as most of the time I clean out my folders and may not have the image anymore.
Instant Blacklist
- Chargebacks with no attempt to contact me and repaying the deducted amount.
- Not fulfilling a payment plan with no attempt to contact me on the situation.
- Stealing a design from me or an event held by me.
- Using a design by me that you did not purchase.
- Your account will get striked if you break my TOS. 2 strikes will lead to your account being on my Blacklist and being blocked.
- Backing out of a bid/purchase with no good reason (such as an unforeseen emergency).
- Reselling a design for higher than the purchase price or a design that was not purchased.
Co-ownership
Accepted regardless of any form a design was obtained (set price, auction, trade, prize, gift, etc.)
The co-owned design is to be treated as a single design/character.
The same reselling/trading/voucher gifting rule applies; Do not resell for more than you purchased the character.

Payments
Payments must be made with Paypal (USD) or in DeviantART points.
Payments must be paid in full before the artwork, design files, and usage rights are transferred to the buyer.
Failure to pay within 48 hours of winning an auction/buying an adopt/MYO ticket may result in a warning or ban from purchasing from me or purchasing any of my Closed Species.
Payments will be sent via invoice to the buyer by BabyPippo or Closed Species guest artists.
No refunds or exchanges are not allowed in any circumstances. I retain the rights to money paid to me and guest artists.
Filing a chargeback will result in a permanent ban from ever purchasing from BabyPippo and any of my species / Events. Your name will be posted publicly.
Payment plans
Eligible for cash-only payments over $200 (payment plans not available for points-only payments).
Each user is limited to one payment plan at a time.
A minimum of 25% of the total value is required as upfront payment.
The maximum time is a 3-month period for the full repayment.
To minimize Paypal transaction fees, payment plans will be made via one invoice (minimum per payment set at 20% of total price).
If payment plan cannot be fully made within the 3-month period, no money will be refunded to the buyer.
You will receive full ownership and the design's unwatermarked file(s) after full payment is received.
Vouchering
You can only voucher for the original sold price you obtained the design for and any commissioned art costs.
If the designs were obtained through a draw-to-adopt, raffle, or any competition you can only voucher designs for the amount you spent on commissioned art instead.
-Once a design is obtained via vouchering, you cannot resell it; re-vouchering, trading, and gifting is fine.

Commercial use
This fee is non-refundable.
The commercial usage rights last for the entire duration the design is owned by the holder of the design who purchased those rights.
It is for profit usage at a personal level. This includes merchandise such as zines, artbooks, charms, comics sold at a small scale (<100 units).
Designs made solely by me can be used commercially by paying a commercial fee of 200% of the original price.
Commercial usage gives users the rights to profit from creations that use the design. Rights to the artwork of the design still remain with me the creator.
Designs with commercial usage rights are resold at their original purchase price (which excludes the commercial use rights fee).
If the new owner wishes to have commercial usage rights, new commercial usage rights needs to be bought from me.
For designs that are partially produced by me (i.e. collaborations), the commercial use and the fee will vary by case as it is to be determined with the other artist(s) involved.
Commercial usage rights for a design cannot be transferred between owners. If the new owner of the design wishes to use the design for profit, the commercial use rights need to be repurchased. This means the commercial usage rights for a design is attached to the users, not the designs.
In co-ownerships, the commercial usage rights go to whoever pays for the commercial use fee. If both owners want to commercially use the design as separate characters, a different commercial fee will need to be negotiated.
While commercial use will not change, reselling rules may be subject to change when the T.O.S is revised and updated. You will be noted for commercial use changes.
- Designs made solely by me (Babypippo): 200% of original purchase price.
- Designs made by me (Babypippo) in a collaboration: varies depending on the collaboration artist's own commercial fees.
- Designs not made by me (e.g. Guest Artist designs) but in my Closed Species: 55% of the original purchase price.
Closed Species use
The Closed Species lore and references I make are just "guidelines" which may inspire how you want to create your character. You are free to stray from the lore if you wish. (Referring to things such as their height, age, having owners, etc.)
Species-specific traits can be removed to become kemonomimi/humanoid.
Once you've altered the design where the main characteristics of the species are no longer there (in this case, the button, perfume, pumps etc) then it is no longer considered a "Parfumimi". However, reselling/trading/gifting the original, unaltered design would not change its Closed Species status.
Adopt coupons
1 year expiry, no extensions permitted.
Only applied for designs currently for sale created by me only (excludes collaborations, Guest Artist events not by me)
Can apply to set price and auctions, but not OTAs or customs
Can be used in parts, e.g. using only $40 of the $80.
Cannot be traded off or exchanged for money; ownership cannot be transferred.
Cannot be “refunded” or “revoked” if you change your mind on the design you apply it on.
The adopt you applied the voucher on will maintain its original sale value, but it cannot be resold. (Trading and gifting is fine. Vouchering and reselling for the price of paid commissioned art is acceptable.)*This applies to partial use of the voucher e.g. Using $40 of the adopt voucher and paying the rest of the $10 for a $50 design.
