General Adoptable Guide


What are adoptables?
Adoptables are generally original characters and/or designs that people create, which may be new or no longer in use, and are sold the usage rights of to another person. Rather than deleting them, the original creator would "sell" the design or creative rights of that design to the next owner, thus creating a form of "adoption".
For a general idea, adoptables are purchasable limited licenses to use an artist's art & design which is limited by the artist's TOS.


How do I participate in an auction? What are some terms used in an auction?
To participate in an auction, please place an offer under the respective 'bid here' comment.
  • Bid is basically a money/point offer
  • SB or Starting Bid is the minimum price of the adoptable which is mentioned in the adoptable's description.
  • AB or Auto-Buy is the buy-out set price that will allow the bidder to own the adoptable without having to wait for other bids.
  • MI or MBI or Minimum Increment  or Minimum Bid Increase is the minimum amount of money/points that a bidder needs to add to the previous bid to beat it. Or depending on the auction, there might be a MBI which means your next offer should exceed the previous by at least the MBI
  • HB or Highest bid is the highest offer for an adopt the current time,  it is bidder's responsibility to check for the most current HB
  • OB or  Outbid  is when your bid has been beaten by a higher bidder
  • Autobid is when someone tells the artist hosting an auction to automatically add an increment above the current HB if they get outbid so that they remain the HB while they are away/offline. this is something that doesn't happen often if at all anymore, so this practice is pretty much obsolete ... but nonetheless, the term autobid still means what it means and it DOES NOT MEAN THE SAME THING AS AUTO BUY. *** We do not allow these if there is an Autobuy available! It is typically bidder's responsibility to bid


What is Set Price?
If an adopt is labeled set price, it can be bought without an auction at the designated price.


What is an Offer to Adopt or OTA?
Depending on the adoptable's description, a bidder may offer different payment methods if described.


What is a Snipe Guard?
When a bidder bids last minute before the auction has concluded (sniping), the auction time will be extended for an allotted time to give other bidders a chance to respond.



What is a Color to Adopt or CTA?
A color to adopt is an adoptable contest, in order to join a CTA, a participant must follow rules and guidelines provided such as coloring lineart provided in order to get a chance to win the design. The winner of the CTA will be chosen based on terms stated in the CTA contest


What is a Draw to Adopt or DTA?
A draw to adopt is an adoptable contest, in order to join a DTA, a participant must follow rules and guidelines provided such as redrawing the adopt provided to get a chance to win the design. The winner of the DTA will be chosen based on terms stated in the DTA contest


What is a Choose-Your-Own-Palette or CYOP?
This is considered a semi-custom adopt, where the owner of the design can request for certain colors. However the lineart of the design is set and cannot be edited.


What is a Raffle Giveaway?
This is a way of adoption where one must follow rules in order to enter the giveaway. The winner will be chosen randomly.


What is a YCH or Your-Character Here?
This is commission/custom with a pre-set pose. The base/pose is not editable and you can ask your character to be placed there.


What is a Quotelist? 
A list where you have users interested in being notified EVERY TIME you have a new adopt available to buy

Other Questions



Can I ask you to edit art purchased?
  • Unless we made a mistake we do not edit finished artwork without additional charge. This includes adoptables.
  • If you'd like us to edit our work we will ask for additional fees and have right to decline if requested.


Who draws most of the adopts/art?
  • A majority of adopts are collaborations. Thus both of us work on one piece. Not split up the adoptables in a batch as we have lots of art styles, and our styles are different.
  • We sometimes note who does what in the artwork or if its drawn solely by one person.


My Commission isn't finished; why do you open slots or sell more adoptables?
  • Because there's two of us, one partner may finish and/or have free time while waiting on other. (One is faster than other)
  • Also we have adopt weekly schedule, we work on along side commission, and it is our goal to always meet this schedule to be consistently active to our watchers and buyers and especially to our patrons who support us and see these consistently.
  • If commissioner not comfortable seeing adoptables or art being released regularly while waiting their turn for the finished commission from us, please don't order >.<"
  • Besides commissions and customs listed on our account, we may have work elsewhere listed on our individual account.



Can you lower the price of the adopt so I can buy, or give me unsold adopts for free?
  • No, we typically never lower any of our adopts or give an unsold ones for free.
  • If you can't afford, don't buy from me
  • They are all up for sale if they are open. DO NOT ASK IF ITS FOR FREE because it's not.



Aren’t your prices too expensive?

A lot of things are wrong with me, I’m a garden-variety depressive neurotic who’s trying to get by doing what I love as best as I can, and what I love happens to be something people have less respect for than a burger at MacDonald’s, because at least a burger is seen as a commodity but art is seen as an entitlement. The process of “I want something and I want to exchange money for that thing” seems to escape people when it comes to a talent labor, and it’s not about if you, personally, can’t afford me, it’s about looking for clients who actually can, because those people exist, as mind-blowing as that is for some out there, and because even artists have to pay rent every month, and to do that they need the strength and belief they can name the price that feels fair to them. Whether that’s fifty dollars or five thousand is not up to you, they’re their own business and their decision making on their services isn’t a democracy, you don’t get a vote in it.

I’m not a personality that’s easy to bully, and I’m fine with whatever you think about me because you don’t matter to me. You’re literally not a priority in my life. I will delete your comment and go back to drawing for myself or people who have made themselves a priority to me. You might vilify me as having a superiority complex for that, as being dismissive, or, as you say, an egotistical shithead, and you know what? I agree with you. You’re not wrong. Even to a friend, when I said “No offense, but I will not draw your characters unless you pay me,” and her response was, “Aren’t WE a little fucking princess,” it didn’t take a lot of thought for me to say, “No, when it comes to my art, I’m a motherfucking queen.” I wasn’t even angry. I wasn’t offended. It was a fact I was stating. I have the authority to dismiss you and I won’t give that up for anyone.

But that’s me. I know my value. I know what my time’s worth. I know what my art is worth, because every minute I spend drawing for other people is one less minute spent on my vision and my stories, and those minutes should be paid for. And it makes me sad that it’s people like you that make it hard for artists to learn that, how hard it was for me to learn that, and I hope that me typing all this out will make them realize how people like you are about as important as a bad fart smell. You’ll be gone with the wind and they’ll still be there, doing what they do.

So I’m guessing what you’re really asking is “how can you have more value in yourself than what I think you deserve,” in which case you’re an asshole, and don’t commission me.





Can you give me advice on how to sell adoptables / interest in my art?

Sorry. What we do may not work for every artist/adoptmaker so don't want to give out bad advice.... , but artist should get to know their own customers! They don't bite hopefully.



 Can I give a suggestion, critique, criticism, and/or advice to you?

Please don't, unless we specifically ask and request of such.

We have designated areas where we accept suggestions such as polls or journals, as we want to be able to keep track of suggestions and be able to refer them.

Unsolicited (not asked for; uninvited, unrequested) suggestions, critiques, criticism, and advice are not welcomed.
Criticism is never welcomed.
Despite some having good intentions, it is not fair for us for others to expect us to remember every random suggestion/advice/critiques given.
Neither is it ok for anyone to assume we will automatically agree to them or that we need help.
We hope people understand that it is our choice to accept or reject their advice/suggestion/critique/criticism; it is not up to them to decide how to handle our business.

Adoptable Rules

  • Only the owner of the adopt is allowed to use it.
  • The adopt is licensed only for personal use (non-commercial purposes).
  • You may redesign/ modify after adopt but it would be nice if you kept it recognizable. 
  • You may gift, or trade after adopt but you must note me who is the new owner. 
    • Exclamation  Owner must be explicitly clear that they are gifting or trading.
        Trading or Gifting with misleading or vague word terminology that goes against our TOS may not be allowed as it can be associated with scamming in transaction and/or breaking our TOS.
      (ie. "Trading for Money "; "Selling for Art"; "Gifting for Currency"; or similar variations is not allowed. )
    • Exclamation  Failure to directly notify us of new owner transfership can result in blacklist. (Toyhouse does not notify us transferships, and we do not consider them valid permanent proof)
  • Customs are only allowed to be resold at same price or lower value by the buyer.
    Premade adopts are not allowed to be resold (unless explicitly stated allowed otherwise).
    • To clarify, the no resell premade rule was added to adopts created in March 2015 and onward to discourage rule breaking and scamming. If you have purchased an adopt before March 2015, your adopt may have a listed resell rule on the original adopt listing.
  • If you obtained our adopt through trade or gift, the adopt can only be traded or gifted. Do NOT resell under any circumstances.
  •  Serious purchases and bidding only!
    • Exclamation Retractions, Hiding/Removing Bids, Backing out of Bids/Payment, Chargebacks, Joke bids, Bid Rigging, etc are considered nonserious bids and purchases 
    • Exclamation  Do not hide bids; we will blacklist. Please let us know if you made a mistake.
  • Credit for the design is always appreciated.
  • Exclamation  Bid rigging or manipulation or blacklist evasion will be blacklisted. (Using an alternate account to manipulate auction or assumes another account to purchase goods despite being blacklisted)
  • Exclamation  Our typical payment period of any adopt is 24-72 hours meaning e-checks are not acceptable as they take 5-20 days.
  • Exclamation Please tell us if you put our art up on pinterest! We typically take down all of our art off pinterest due to people reposting without asking for our permission. It's really rude and inconsiderate of them. 
  • Breaking our rules and terms of services puts buyer on blacklist, and we will take back our adoptable without refunding.  (Double Exclamation   For clarification, takeback policy does not apply to valid purchases under our TOS. Takeback policy is applicable to certain circumstances of chargeback, scamming, etc )
  • Exclamation Installment plans may be possible depending on the adopt/auction, but must be discussed with us first and must be approved by us.
    •  If buyer/customer is not past customer of ours, we require at least upfront payment of the highest bid (If no bidding is being place, SB is required)
    • We prefer installment plans to be discussed before bidding or else; we must follow our TOS you bidded under which has a time limit for payment.
    • Installment plans are typically only for AB's
    • Failure to pay for installment plan is an automatic permanent blacklist
  • We can hold for the allotted payment period designated on the adoptable's description, but please ask. 
      • Anything longer than listed hold can only be requested by a frequent adopt buyer/customer of ours. 
        • Exclamation Frequent customer/buyer do not automatically get a hold privilege as it is up to our discretion
        • Exclamation We do not do indefinite holds or vague or uncertain holds, such as maybe getting payment in the future or the next day
        • Exclamation Failure to pay for a hold is an automatic permanent blacklist
    • We do not do holds if you plan to pay with points!

Communication

All communication will be made via deviantart comment/note on RumCandyAdopt or on toyhou.se or on our furaffinity account rumcandy
  • Please fill out the commission form when requesting a commission if commissions are available.
  • If by any chance you would like to contact us through a different method such as e-mail or another website, please discuss with us, so we can arrange a convenient method.

Concerning Commissions, we will contact you...
  • If we need additional information regarding your commission/adoptable and/or payment.
  • To confirm receipt of your commission form or adoptable purchase
  • If there will be a delay in the commission/ adopt delivery
  • When we have a WIP to provide you if you requested WIP of commission is not given unless asked by Commissioner or else the final product will be only delivered
    • Revisions can only be asked for upon delivery of WIP once.
  • If we have to cancel your commission for any reason.
  • To deliver the final product
    • Unless the artist makes a mistake, revisions will not be made free of charge and will require additional fees
    • The final product will be in digital format PNG or JPEG and will not be delivered physically.

  • If we need additional information regarding your adoptable or payment.
  • To confirm receipt of your adoptable purchase
  • If there will be a delay in the adoptable delivery
  • If we have to cancel your adoptable purchase for any reason.
  • To deliver the adoptable
    • Revisions or Edits will not be made free of charge and will require additional fees
    • The final product will be in digital format PNG and unwatermarked, and will not be delivered physically. 
  • If buyer or another individual has infringed on our terms and concerns you.

  • To change or update your commission information.

  • To notify us of new Adoptable Owner or transferring of ownership of an adoptable.
  • To request a hold or offer a price/bid on an adoptable.
  • We only do holds for the allotted payment period designated on the adoptable's description. Anything longer than listed can only be requested by a frequent adopt buyer/customer of ours.
  • We do not do holds if you plan to pay with points

Pricing


Commission Prices are listed as base prices as estimated $$/hour
  • Certain options may be slightly more or less expensive for various reasons.
  • Base prices and expected turnaround are listed
  • Additional charges may be made depending on your request, and may also affect the turnaround time.
  • We will not charge for extra time if there is a delay with your commission or if otherwise take longer than expected.
Adoptables are based off different pricing and thus may not follow the listed details above

Payment

Payment is typically to be made upfront through Paypal in USD (Point may be allowed depending the situation or if stated)
  • We reserve the right to withhold any completed commission, adoptable, or work in progress preview until the full payment is received.
  • Please do not send any amount of money directly to our Paypal or points to RumCandyAdopt account unless explicitly instructed to.
  • If under any circumstances the buyer cannot pay the full amount upfront, please discuss with us, so we can negotiate.
    • We highly suggest buyers not to AB, bid, or purchase adoptables or commissions if they do not have money on hand.
    • This is also if you are interested in paying in installment.
  • We will not under any circumstances give the unwatermarked full-res version until full payment has been given.
    • We will not give lineart of premade adoptables to adopt buyers, as premade adoptable buyers only receive what they have won as listed.
    • Commissioners are allowed to request for line art upfront however if applicable.

Cancellation and Refunds

We reserve the right to cancel your commission or adoptable purchase for any reason at any time
  • In the case of a cancellation on our end, 
    • You will be issued a refund excluding fees
    • or refund equal to the amount of work done prior to cancellation.
  • In the case of buyer breaking our TOS and Rules,
    • We have the right to take back what was purchase and resell it as a premade without refunding the buyer for breaching contract (this is applicable to both commission and adoptables)
      (Double Exclamation   For clarification, takeback policy does not apply to valid purchases under our TOS. Takeback policy is applicable to certain circumstances of chargeback, scamming, minting/NFT, etc )

    • Buyer will be blacklisted and unable to purchase any of our adoptables or commissions
We do not issue refunds for completed commissions or adoptables under any circumstances

Rights and Distribution


We retain the rights of distribution to the completed image, and have the right to...
  • Display it in one or all of our online galleries
  • Display it on this website as an example
  • Display it to promote our commissions and adoptables
  • Dictate where it can be posted if necessary
But will not...
  • Reproduce and sell for additional profit.

We accept private or anonymous commissions, but require that you tell us ahead of time if you don't want your commission posted or have your name attached to the image. But private or anonymous commissions may be more restricted with displaying our work publicly.

Once you've received your completed commission, you may...
  • display publicly in a personal gallery or website layout
  • crop for personal use in an icon or banner or website
  • use for non-commercial purposes (personal use)
  • display in a character reference (and overlay text for such purposes, if necessary)
Once you've received your adopt, you may...
  • display publicly in a personal gallery or website layout
  • crop for personal use in an icon or banner or website
  • use for non-commercial purposes (personal use)
  • display in a character reference (and overlay text for such purposes, if necessary)
  • redesign/ modify after adopt but it would be nice if you kept it recognizable.

  • display anywhere without appropriate credit when applicable (a simple '  by rumcandyadopt.deviantart.com ' or if on toyhouse, crediting our account rumcandy is preferred )
  • reproduce and sell for an additional profit  
  • Exclamation  mint & sell adopt/custom/commissions for NFT or as crypoart
  • claim the adoptable artwork as your original design
  • resell a premade adoptable or a commission (unless explicitly stated allowed otherwise).

We will send you a paypal me link or an invoice or a paypal button link 
requesting payment from buyer.
  • You can pay with card through paypal invoice or button link
  • Since we do not require shipping for digital goods. 
    • If paypal asks for shipping address, and buyer cannot remove it, you can type gibberish and do not have to put your address.
      Bullet Aqua Invoices and Buttons do not allow buyer to remove address due to some update
    • If you forgot to remove shipping address, don't worry.
      Bullet Aqua We will mark all payment received as "ordered processed" to make sure paypal knows payments do not need shipping.

so we can create an invoice and send it to your email.

It is best to provide paypal email, so it can directly notify buyer on paypal account.

Exclamation Added to TOS we do not allow NFT or minting our art into crypoart (though it should be already covered by noncommercial use clause)


The journal format keeps breaking though so gonna have to go back and clean it up when I have time ;u;

Ok so the scrollbar div table seems to no longer work on eclipse (it shows on stash just fine ) so I removed that.


Div containers seem to not show up properly in eclipse.... it seems the inner ones do but also mess up so not gonna figure that out... but added star dividers just in case tables don't show up in eclipse

Also updated social media section in the journal, since I realized the description for journal in eclipse is gone

(I remember putting our full social media there with updates but eclipse wiped that out )

This might be stupid, but can I ask why we can’t use the design for commercial use? I understand not using the artwork but not the design itself :0

This tos is only for personal and non commercial use, and we sell under these terms.

Commercial use license would have be negotiated for under different terms and different fees would apply based on agreed negotiations. We also are not very willing to offer commercial usage due to various reasons.

It does not matter why honestly though. An artist does not have to permit commercial usage for any reason. So hopefully you understand.

I don't really think we need to debate or explain why one or not the other when our TOS is non-commercial usage all together though...

2020 November 9 Update:

I have added the following lines to our TOS as dA has limited point withdrawal to paypal to only core members (It should show up under payment section)

  • We will not accept points as payment if our account does not have core membership. So da points may not be available payment method in future.

this line" Breaking our rules and terms of services puts buyer on blacklist, and we will take back our adoptable without refunding. " was unclear


I have added " ( For clarification, takeback policy does not apply to valid purchases under our TOS. Takeback policy is applicable to certain circumstances of chargeback, scamming, etc) "


I think this was put in there 3 times since we tend to repeat stuff in our tos.

I tried looking for it, but I’m not sure where your link to your blacklist is. Do you not share that publicly, or am I just having a difficult time looking for it on mobile?

We do not link a public blacklist, and those who are blacklisted publicly are only listed on relevant works they have broken tos on. We also do have a private compiled blacklist we refer to however as we do note scammers that others come across.


In old da layout, we could search the term “blacklisted“ so works listing a blacklisted person would show up however. Search is rather glitchy in eclipse and shows wrong results at this current time. We hope staff fixes this issue as we reported this bug.

Updated the Adoptable FAQ
 It only mentioned character designs and the faq we created was only for characters designs in mind in 2014, way before we even started creating outfits.
Hopefully it clarifies a bit more because there's some discourse over this topic :/

Hello, I have a couple questions~


1. I understand the designs cannot be resold, but what about art commissioned later? Is it permissable to trade the adopt design, but require payment for the additional art?


2. Would the following scenarios fall under personal or commercial use?

a) Using the design in a free game, but allows the player to donate however much they want.

b) Using the designs in an original story submitted to a contest (with monetary prize).

Hi!
To answer~
1) We would allow trades/vouchers for that scenario ^^ But for vouchers, please check in with us first as we only allow them in certain cases. We noticed people do shady business with vouchers without our awareness so we don't specifically put in our TOS it is allowed (because it's not always), and rather owners check with us first to get confirmation from us.

2) They are both considered commercial use. We consider anything where you obtain monetary gain, indirect or direct, to be commercial use
a) Donations are considered a form of monetary gain, and using our design indirectly to get a donation would be considered commercial use
b) We also would consider contest as commercial enterprise as you can still earn income under your scenario (or possibly including if you join since I do not know the contest details and the contest may view all entries as commercial depending on their terms )

hi! i had a question, do you allow 2 owners for 1 adopt? i have a character that i adopted from you that i might co-own with a friend (with your permission of course) but i would be the official owner for it, if not thats okay!

Co-owning is fine!
Your friend should be fine as long as they list you as the owner when they upload adopt work. Otherwise we might accidentally take down the work with dmca, so if you're worried about that, it might be best to add your friend as co-owner publicly so we are aware of that.

The rules just appear to be a tad bit vague in some areas? At least to me  they do. I am so sorry if they don't seem to you guys, but I get easily confused, it says only the owner may use the adopt, and I'm sometimes things just go blank and I don't know what to think about things. Sorry if that sounds weird. D:

Ah I see.. We think it's easier for people to ask then if they're unsure, because we honestly cannot come up with every scenario that people think of...... that is rather impossible ^^ (And when we created our TOS we didn't want it to be very long )

We do say the owner can only use the adopt meaning if you don't get permission from the owner, don't use it which I think makes sense.

So if the owner allows someone to draw their character. We will not have issue. We will have issue if people don't get permission from the owner. (We do have random strangers asking to use our work or just using our work without permission, so that clause is to deter people from thinking it's ok to freely use our work especially when it's owned by a buyer)
