If it isn't Satire and is found to be purposely fake and poses a threat to national security then yes. If it's a negative and is about a person or business it's considered Defamation of Character and is illegal.

I agree! Satire and jokes that are obviously sarcasm shouldn't be prohibited because that is the point

I think there's a big gray area on this topic because if they write some post about how they discovered cats have 6 legs and the other two are located inside their bodies isn't harming anyone, but is still gaining tons of money from ad revenue by making clickbait titles for people to read documents that aren't even true, do they legally deserve the money they get? I mean they didn't risk any person, company, state, country, etc after all

On the other hand regulating strict law about false news would mean that governments of the world be invading your privacy telling you what you can and can't write checking for false news, since it would be hard to regulate laws like that without being so invasive

And what if someone found a post or news story they thought was real and started spreading this false news in oblivion? Does this mean they would have to be charged as well?

It's a thought that came to me last night and I was interested to see what others would think with all of this to consider

I remember when the Call of Duty (I think?) VERIFIED Twitter account changed to a fake news station account to make fake news about its new game coming out and made a tweet about a bombing in a real country and people retweeted it thinking it was real and being worried about their loved ones living in that country
