A while ago I wrote a post about DA's uneven banhammering of 'sexy' fanart, and that it wasn't out of moral compunction but rather legal necessity. - invinciblewonderbeast.blogspot…

Doesn't surprise me in the least, actually. A LOT of stuff gets taken down out of fear of being sued. Sometimes the company is being realistically prudent...but other times, it just strikes me as hair-trigger ass-covering cowardice.
(Not that I've drawn any fan-art that could get me/DeviantArt sued..._yet_. I could if I WANTED to, though...)

I'd say less cowardice (in DA's case) and more that it's a legal necessity born from overreaction. The entire endeavor is pretty silly, and some owners of franchises are pretty nutso (particularly Warner Brothers, it seems) about 'enforcing' this -- there's even companies/authors/artists who attempt to forbid any fanfiction/fanart from being created.

Well, that's more what I meant, actually--overreaction. I just didn't think of the right word in time. Heh...
Anyway, yeah, I know--some companies/creators are pretty cool as long as you don't try to make people think _you_ created the characters/world/whatever--but others...? Yeah.

I'm also trying to think of some franchises that tend to be b&ed a lot - I've noticed it more with stuff that airs on either Nick, Cartoon Network, or any of the 'kiddie' cable networks. Which makes sense, as those companies have armies of lawyers at their disposal. Some anime franchises, too - particularly popular ones.

I just wanted to let you know that I love reading your journal articles. You're eloquently hilarious, but at the same time, you have a point.
