FAQ #894: Can I run a lottery, raffle, sweepstakes or other random drawing or game of chance through my DeviantArt account?





Hello lovelies,

This is kinda a rant that I wanted to make days ago, but I didn't have time to write this. Also I was waiting for a helpful reply from the help desk that I contacted about a week ago asking many questions and what I got was confusing. That's the only word I can use to describe it.

So, everyone makes raffles and giveaways, people like them. But apparently, you are not allowed to make them anymore. No matter the prize you choose to offer: points, money, pm, art(?), tablet(?), etc. All a no no. :B



Kind of a summary (my understanding of this whole situation):
  • da banned lotteries in 2010.
  • I found a comment from 2013 from a staff stated that point raffles not allowed, but pm raffles are fine.
  • A week ago, da banned contests and raffles that offer points and money as prizes because of legal issues.
  • then around a couple of days after, all kinds of raffles and giveaways are not allowed because they don't know if the winners were chosen fairly. And FAQ #894: Can I run a lottery, raffle, sweepstakes or other random drawing or game of chance through my DeviantArt account? was updated.
  • then contests that offer points and money are allowed again.
  • art raffles might be still okay because the FAQ I mentioned above is listed under points. I tried to ask the help desk about this too and all I got was that 'games of chance not allowed. Like I said, not helpful.



Alright, not allowing something because you have to follow the law, is fine and understandable. But not allowing them because you think it might not run fairly? :hmm: Apparently, you can't choose someone random, you have to choose a winner according to a certain criteria, like skill or creativity and that just makes it a contest. You know, I never saw anyone complaining about a raffle being unfair, that the winner was chosen unfairly. Because why would anyone get mad that a random generator didn't chose them? that's so unfair! they clicked a button to enter this raffle! they wasted a second of their life! I would understand getting a bit annoyed that the host canceled the raffle, but that's just it.

You know what I mostly see people complain about being unfair here on da? contests. Whether official da contests or contests by members. Many complain because they put a lot of effort and time to make their piece. Host gets many entries, then they cancel, chose an entry that contradicts with the criteria they stated they would judge on, etc.

But hey! contests are obviously conducted fairly because the host said they have criteria! You won't be scammed! Problem solved!

Same thing can be said about scavenger hunt events and kiribans. They can be manipulated easily. But hey! they're totes fine!



Anyway, I obviously don't want contests to be banned. I'm just saying everything can be manipulated and conducted unfairly, but choosing the less harmful of them to ban because of this excuse is ridiculous.

I'll continue my own watchers 'raffle'. I'll probably just have to ask the participants to answer a question and the winner will be based on best answer. Or something like that. Just to make my 'raffle' 'fair' in their eyes.

I'm read the rules, and I'm wondering.
If I wanted to do an art contest that was pay to participate, would that be against the rules? Because that seems more exploitable than random number generator.

I don't get it tho.
How is it that point raffles are somehow giving them troubles with the law??
If I say I'll give $15 to a random person, how is this against the law? Or what? I don't get it.. x.x

No like, if I have to pay $5 to enter your art giveaway that's not allowed, but you saying I'm going to pick a random person to give $5 to is allowed.

Does this mean free art raffles mostly the ones that are fav the journal then random number generator picks the winner is considered legal with dA?

Oh okay!I'm glad the FAQ about raffles was updated and worded better.It was really confusing what kind of raffles were not allowed on dA,it even confused me when I saw raffles floating around dA and not removed after that new rule was posted out of nowhere.I literally thought that all raffles were banned which would've been such a huge let down but thankfully some kinds of raffles are allowed.

Disclaimer I am not able to speak for DeviantArt, but after reading the FAQ, their policy seems clear to me:

First, a raffle, by definition, requires payment to participate. It is the same thing as a lottery. The point of a raffle is to raise money for the group running it. The participants are basically gambling, and gambling is heavily restricted by law. This is why DA bans them. "Games of chance" means gambling.

Therefore, as long as there is no "payment" required to win, then I don't think your prize giveaway will violate the rules because it is not a raffle or lottery. I suggest you do not call your prize giveaways "raffles" anymore, so that you will not confuse DA's mods.

Summary: You can give away points or art to a randomly chosen winner, as long as you do not charge them to participate.

What you're describing are lotteries and they are banned since 2010. :/ They banned raffles (free to enter) just recently and removed a couple raffle journals.

EDIT: oh I see they updated the FAQ again. :O

that kinda sucks - this would be because of the $500 raffle, im sure - it started this whole thing recently i think - the sudden flail on raffles, because it got super big and got every-ones attention... but i agree 110% contests can be FAR MORE SUIFF than raffles, and honesty, a screen cap o results is fine y me i dont winge and whine if i dont win :? and im going to stream the results of my next rafle - upload it to youtube so people can see how fair it is :/ 

and i think i will do that too :/ its crazy man.

That FAQ talks about Paid games of Chance though. If you want to tell people to fav a journal entry so you can pick random numbers from the fav list to give points to, it's not infringing the rule.

That's lotteries which were banned 5 years ago. They removed raffle journals recently which is not pay-to-enter, but fav/comment/advertise kind of raffles.

I'm pretty sure they don't just browse the journals portal or the forums looking for raffles. There aren't many staff at the help desk anyway. They just handle whatever people reported to them.

True, it's usually the contests people whine about because most of the people don't know how to held them right and then the participants get angry. I don't want contests to be banned though, especially with the money prizes because participants deserve to be paid for their hard work, just like commissions :c

Sometimes raffles are not fair and I guess this is what DA wants everyone to see. I know people who have made point/money raffles to just gain more watchers and views. In the end they could say that they picked the winner randomly but sometimes the winner is their own account that they made ages ago for this raffle. So in the end, no one wins but the raffle maker self. People are sneaky :/ And now everyone has to suffer about this ban stuff, even those who run raffles fairly

Raffles.... have to end every quickly tho.
Because of the old rules coming to the surface again, many people still hosts point raffles but they only hold it for 3-7 days to avoid the admins noticing.

They banned points raffle in case cheating from the participants happen like making an alternate profile to increase chance of winning or stuff.
(The problems not really from the conductor of it but the participants)

This thing that raffles are unfair has no sense! In raffles everyone is equal to others, so anyone can win! It's the most fair thing ever!
I wanted to do an art raffle to celebrate the 300 watchers goal, with lots of prices, but now I have to turn it into a contest and I don't know how! I want everyone to be equal, but in a contest that's not possible... I'm  trouble because dA rules are stupid!

The one time I entered a contest, I felt I was one of the few artists who followed the criteria. When the winners were announced, they were pieces that were exactly what the host said they didn't want. I talked to others who all agreed that the contest was unfair and rigged. I'll never enter another contest.

Raffles are random. I trust the host to be fair, but since they require minimal work and are random, I expect to lose.

this happened to me in a contest I joined a couple years ago.. the first prize winner was an entry that BROKE THE CONTEST'S RULES (which was not being allowed to use any part of a piece you had made for the contest holder prior to entry) and.. that's what the winner did :V

Since then it's put me off contests period.  I don't even care that I didn't win, just.. that kind of hypocracy is unfair to everyone who entered.

I don't really have a problem with raffles or see the point in banning them really. I get it's the law and all but the logic behind this law still makes no sense to me no matter how many journals I've read about it.

Well, i do agree that is unfair. Like seriously it's not like they care. They never did until now. How is it unfair? I guess only choice of holding raffles are on other sites, like Facebook, tumblr, Twitter or even Youtube.

I always thought that raffles and kiribans were unfair,because it's just about luck.But oh well !Giving out art for people that won the raffle or the kiriban seems..Fair to me.I know it's only luck,but some don't have enough points to buy commissions,and they would love to get art from their favorite artist.So instead of paying,they just throw every thing on luck.

The admins are just being silly. I agree with you about their silly 'unfairness' excuse. I had art trades with people, I finished my parts and I never got anything back, and its been years. I know that this has happened to other people too. And in secret santa giveaways as well. And commissions too. I've seen people pay for a commission and they never got a commission back. Or worst, they were scammed by an art thief pretending they made some drawings and offer to do commissions, and then they never see their money again. My point is this... those things can be unfair, but the admins won't pull the plug on those for some reason? But they do on contests...? 

Heck, I actually contacted the help desk about whether contests are allowed or not, and I couldn't even get a simple answer of yes or no. R2 just linked me to that faq there, and gave me a copy pasta about raffles. But I didn't even ask about raffles and I couldn't through to them whatsoever.  

This site is really going down hill now. I'm glad I've got an extra place offsite as backup now. I don't know what's worst, this or the fact they tried to justify the price increases over the sake of coffee; and that was the only excuse they had.

Contests are fine as long as the contest have entry standards.
Art raffles are fine. But not points.

Even if they aren't, some people still do but for the period of 1 week or more only, to avoid the admins noticing.
(Also, when contacting the help desk, they mostly send it to your e-mail account, not your dA account)

Yeah, they did say that giving POINTS or CURRENCY isn't allowed. No mention of art tho.
It's also best if the deadline is a few days or a week away so it doesn't catch the admins attention.

(The person who's raffle was banned, exceeded the point donation limit + it was very, very popular. It was in the "What's Hot" page for more than a month i think)
