Thanks to the keen eyes and kind consideration of  :iconmadamem:
I've discovered that a set of my brushes is being offered at another website by someone apparently claiming them as their own.

I know this is a problem for many DA artists and stock providers and I'm sure I'm not alone in my frustration and anger. My question is,  WHY do people do this?? I just don't understand the mental dynamics of the offenders. I mean....is there REALLY any satisfaction to be had in claiming you created something that you didn't? I'm definately not above enjoying a pat on the back or a little ego stroking, but I want it to be for something I'VE done!

Anyway, in response to the incident my future brush sets will include a READ ME text clearly outlining my terms of use (which I don't think are unreasonable) .

The text will read :

This brush set is © midnightstouch      midnightstouch.deviantart.com/

Please respect the time and effort that I put into making these brushes.

They are free for personal use

To members of Deviant Art :  I do grant permission for use in DA Prints. I simply ask that that I be given credit with a link back to my DA page, and that I be notified of their use so that I can check out your creation, fav and add it to my wish list. Off-site use is generally not a problem with me, but I do like to be asked and again, credited with a link back to my DA page.

Commercial use : You DO require my permission, but I'm generally very accomodating

To all users : You may share them, but you must include this READ ME along with the the brushes.  You may NOT alter them, package them with other brushes and/or redistribute them as your own.


If anyone has any suggestions or recommenations for any legal sounding jargon I could/should include in the read me, I'd appreciate the input.

Your conditions of use are very reasonable :)

I've had to note many creators of brushes here on DA because their work has been put on gfxworld without their permission (I'm not sure if this is the website in question lol)

I hate that site.....

Surprisingly enough, it is the website! :lol: And I hate it too :D I'm just thankful that there are DA members around who take the time to let people know when they see their stuff there.

Thanks :hug: It's such a shame that there's no way to stop it. With artworks, a watermark helps, but you can't watermark brushes :giggle:

it is so sad that people feel that they have to steal something that doesn't belong to them just to make themselves look better or smarter than they really are. It usually catches up to them though. So sorry it had to happen to you, just know that their reward what ever it is will never be truly their's because it will also be stolen. :hug: :heart:

Oh I am so very sorry to read what happend and I really hope that you will have such problems as rarely as possible(as you can see never can't be used in this occasion..)...I guess is one thing to forget where you took the brushes from (even so, when downloading them your devart nickname's included in the file name) and it's a totally unfair and different thing to report the brushes as being yours; besides,
I totally agree with you that your terms of use are more then reasonable therefore it wouldn't be necessary for someone to "steal" your work. Really sorry my talented friend! really really sorry! :hug:

It's frustrating sometimes, and I know that it will happen again at some point. There are just people like that around, and there's no getting away from it.

So, I just focus on the fact that there are people who are sweet and caring, like you....and forget about the rest! :D

oohh pick me, pick me. First off, where were the brushes located? Now here is what I learned in my IT102 class....

A copyright is available to the creator of an original artistic or literary work, such as a book, essay, poem, movie, musical composition, photograph or painting, for example. A copyright is also available for software programs and for Web pages. The copyright protects the work by preventing the copying and/or distribution of the work without the creator's permission for a set period of time.

If you advise the site administrator of the copyright infringement they will normally take care of the problem. I hope this helped in some way. If not, then it helped my typing skills. :rofl:

Strangely enough, since I've complained ( both to the site admin and the offending party) , I've been mysteriously unable to connect to the site. But it's here [link] I haven't heard back from either of them

Thanks for the input :hug: Other than contacting both, and including a read me txt with the brushes from this point on, I guess that's about all I can do. There's no way to watermark brushes :rofl:

Hi hun, so sorry to hear your troubles.. I know this kind of thing goes on all the time and lots of it we don't even know about... My opinion on people that do this kind of thing is because they just do not care.. They are lazy and they have no creativity or confidence in their own abilities to be able to do their own work! so, its much easier for people like this to live off someone elses work... its Sad but true.. Just don't let it get you down to where you stop wanting to create... All your work , talents and creativity is highly appreciated by this Community.. and this member (ME) appreciates you very much.. I am glad I found you on here.... :hug:

Thanks SO much. I greatly appreciate the support :hug: You're right, it does go on all the time. It's incredibly sad for me to think that there are so many people out there who find it so easy to take advantage of the hard work of others.

Thankfully there are still, many more people who are appreciative, caring and supportive and I do most of the time, focus on that :) So, I have no intention of allowing the jerks of the world stop me from doing what I love to do. :)

Sometimes it's possible to contact the "host". And if i were you, i would post her or his name here!!! So we all know and can do something about it. I know how you feel. Some years ago i made a poem about my autistic son. Somebody else decided that it was a "nice" poem and put her name under it. I was soo mad!!! It's sad that these things still happen and i wish there was something we could do about this!! If there is anything we can do, please let us know.We love your brushes and you're great!!!!!!!!!!!!!!!!!!! :rose:

I contacted both the host and the party involved, and I've heard from neither. Oddly enough, since I've complained, I've been unable to access the site either. Which I find odd. It's here, [link] if you're able to check it out.

I don't blame you for being mad in your situation either. I'd have been livid too!!!

Other than the contact I've made, I'm not sure there's anything else anyone can do, but I do appreciate the support! Thanks so much :hug: Thankfully the caring folks still outnumber the jerks out there! :P

I am sorry to hear about your brushes being ripped. I am always amazed at how many people can be so greedy/careless/inconsiderate.

Perhaps if you made sure to include your name in each brush title, as well as add your copyright information in the file's actual properties. It would be extra work for you, but maybe it will help to deter people from claiming your brushes as their own.

Well, I've thought about the brush names, but it's easy enough to change the file name. With each of my sets, the first and last brush is always my logo, but that's easy enough to get rid of too. I think it's a good idea to add the copyright info in the file properties, so I'll start doing that. Thanks for your input and support. It's much appreciated! :hug:

gets me how some people are so thoughtless as to the time & energy that goes into creating something. Unfortunately this kind of thing has always happened & will always continue to do so unless someone comes up with a way of putting tags on images & such so they know where they are going. That's a very extreme idea, I'm tired!!! I hope you get to the bottom of it & all gets sorted out soon.
I'd hate to think that someones thoughtlessness would lead to us all suffering the loss of your brushes et al

Frustrating as it is this little incident won't stop me from making more brushes. But I'm definately going to start including the read me with the brush sets. Not that everyone is going to read it, but at least I know I've been clear about my terms :D
