More Stolen Work, But a Different Outcome

Journal Entry: Tue Aug 26, 2014, 10:55 PM
Wow, I found my work being used as a poster with no mention that it belonged to me - my signature/watermark was removed. I joined the site as they didn't seem creepy and didn't require a large amount of info. I filed a copyright complaint with them and they even quoted DCMA - amazing! It actually looks like an interesting site.

DCMA: Digital Millennium Copyright Act

support.google.com/legal/answe…

I also left a message to the thief with a 'shame on you for stealing my work' message.

Here is the link for the theft:

Premonition by Metal-Bender

I actually received a DD for this (because of :iconcanankk:suggestion and :icondpressedsoul: accepting it).

Premonition by *Metal-Bender ( Suggested by Canankk and Featured by DpressedSoul )

It's kind of nice to know not all outcomes are horrible. Of course, it won't be a good outcome until they take my work down.

I found another site that is featuring my work, without consent, for uploads to mobile phones or anywhere you like. I couldn't tell if they charged money for any of it.  They too had a section to report abuse and didn't require joining or any personal information other than an email address.  I'm really surprised - very different than my experience over the past couple of days. At least my signature was still on it. It's going to take a while to look through all of  the postings for this one. This photo was pretty popular for all kind of sites involving spirituality, poetry, winter scenes (it's infrared not winter), Tumblr, Pintrest, etc. I'm not thrilled that they're using it for their own purposes but it's not being offered for sale and my signature is intact. It's kind of strange to see people showing collections of my work, not for sale, just because they like it. Some actually give descriptions of me based on my information on DA.  If feels kind of strange to see that. I guess I'm only going to take issue for people showing my work as their own, using it for advertising, or offering it for sale. This has been kind of a journey and some of the presentations of my stuff as a person's collection are kind of  nice. It's kind of hard to take offense.

:iconfabiokeiner: convinced me that I should join these sites (providing they don't seem questionable) and report the theft of my work. Thank you :iconfabiokeiner: for the good suggestion.

I know this is just a drop in the bucket, but it means a lot. I would encourage everyone who has had their work stolen to fight back and take action. I really don't like the attitude of 'what can we do?' as an excuse to do nothing. Maybe if everyone fought back it would slow these thieves down a bit.

I guess that's enough for now. No worries, I won't keep spamming you with my discoveries - this is going to take a long time to go through. (Well, I might mention something if it's really wild or outrageous.)

After reading your journal, I checked one of my work. And guess what? Yep, it's used on a website without asking for permission and without mention to my name!

soundcloud.com/neospud/dissemb…

I will be more careful in the future. Thanks a lot for opening our (naive) eyes!

I'm sorry to hear that Ben. Unfortunately, it's all too common. I had no idea until about a month ago and when I checked just a few photos and I was shocked. I've checked quite a few more since then and as best as I can tell, my gallery on DA has been ransacked - pretty discouraging for sure.

It's good to take whatever precautions you can. I'm making a lot of changes and everything is kind of a work in progress. It's changed everything for me. Your very welcome!

Much better than my solution -- this would entail me sitting here with a demented smile on my face, saying to myself, "Someone loves my stuff so much!"  But we are in different "leagues".

Ha! That was such a disappointing situation - they just didn't get it. So much ignorance.

Good luck, Peggy. I hope you get the justice you deserve. It's really sad to read and see all these art thefts.
Read a bit of the comments on the motifake site. Almost got a headache from the stupidity of the person who used your photo for his poster. "You are 2 years late..." Well, it still doesn't give him the right to use other people hardly made work.

If you have free time and you like to read, read the following article. It has good examples of typical art thieves and their excuses + great counter-arguments for what they are doing wrong.

Thank you so much Toni! Yeah, those guys are really clueless. I've just sent them a response, including that the copyright on that image is good for at least 25 years. They think I'm being mean and annoying to them but using my stolen artwork is ok. They really don't care. Their response is so typical. I'm thinking of pulling all my work and never posting online again because of this. If I do post again it will be very, very low resolution with a big ugly watermark. Apparently there is free software out there that removes watermarks too. Good grief.

Thanks for the link - I will definitely check it out.

Even though I like seeing (your) photos in very high resolution, I'd still suggest you to upload photos in lower resolution, and maybe make a new watermark that is in place where it is harder to remove. I'm not sure are you being told this already, but you could also place your watermark on alpha channel, so in smaller view it isn't visible, but when clicked bigger/downloaded big, it is revealed. I myself haven't done this, I have just read about it.

Thanks for the link for Patrick's journal - I've actually used quotes from it and shared it with other people. It's a really great journal and makes great points.

Thanks Toni. I've been considering all sorts of options. I haven't heard of the watermark on alpha channel but I will check it out - thanks! I'm not going to be posting on DA for a while, if ever. I'm not sure I even want to be here anymore. I've been encountering DA members who think that art theft is ok because everyone does it. They are all the same - big deal, so what, who is it hurting, it's fun, etc. They are so ignorant. A DA member was defending it on another site acted like my complaints were rubbish (my stolen photo was used for a silly poster) and told me that this was just 'fodder for my journal'.

Very sad to hear all of this, but you do what you feel is right. You have been a very inspirational artist for me and I wish you all the best - whatever you decide to do!

I'm also glad you found Patrick's journal useful!

I hope your luck continues to improve with this.  So many people don't even know copyright exists on the internet and I'm not sure if that will ever change.   But it is important to save your work whenever you can

Thank you so much Elizabeth. I'm getting a lot of attitude from the guys on Motifake.com. They really don't get it and don't see what's wrong with it. They don't seem like bad people but they have been taking photos off of google for their hobby for so long they don't see the harm in it. Well, people need to understand the creative commons license. I'm going to post about it tonight to help people understand it. I'm not sure either - this is a kind of learn as I go experience. Whatever I find, that is useful, will be shared with everyone. It really is. I really can't believe the amount of ignorance and obnoxious attitudes I've been encountering.

It's amazing how many people seem to think copyright laws don't apply to anything on the internet, and how they are content to remain ignorant of it even after they find out they're doing something illegal.  Of course, other people are just jerks and don't care.  I hope the theft dies down at some point, it gets depressing to find your stuff everywhere with credit removed or for sale.  I wish you luck

They don't even care and when you point out what they are doing is very wrong they just get angry, defensive, and obnoxious. It feels horrible to have no control over my own work. These people don't have the talent or imagination to create anything and steal from others. Thank you so much Elizabeth.

 I think a lot of the people who steal are the ones who grew up being able to pirate music and movies, etc. and it just translates into art as well for them.  Bah.

I think that's very true. They do it so much it doesn't even enter into their minds that what they do is actually wrong. Somehow it doesn't occur to them that the art is made by real people and when they steal it really hurts people.

That sucks! I hope it gets straightened out soon. I had a story stolen from me that I wrote, the guy who stole it had become pissed off that I never finished it, and so he left a mean remark at the beginning of "his" story along the lines of at least I'll finish what I started. I was notified and I issued a complaint and it was removed and the "author" was banned. It really angers me when people do this.

For sure Heather. They really don't - it is so shocking. They really don't care and see nothing wrong with what they're doing. They seem to fall into two groups: people who are totally clueless and don't understand or care and people who know exactly what they're doing and don't care.
