Welcome to my commissioning term of service!
I'm thrilled that you're considering working with me to bring your vision to life.
Before we get started, I want to ensure that we're on the same page and that you understand my terms of service.
As a digital artist, I take pride in my work and strive to provide the best possible experience for my clients, and I'm here to help you bring your creative vision to life.
To ensure that our collaboration runs smoothly and that we're both happy with the final result, I have a few terms of service that I ask my clients to abide by.
These terms are designed to protect both of our interests and ensure that we have a clear understanding of what to expect throughout the commissioning process.
So please take a moment to review my terms of service before we begin.

I reserve the right to refuse any commission
Clients must be 16 years of age to apply for commissions
DO NOT RUSH.(I'm trying my best, and my schedule can become hectic.)
Prices shown are base prices that are subject to change based on character complexity and or added elements (this goes ESPECIALLY for avatar retextures in terms of clothing, emission, and metallic layers)
I work best when given artistic freedom to create an image based on the characters you provide: I am happy to match a scene or pose that you have in mind, but please allow and expect some variations.
Queue Placement
Queue placement is determined by the order in which commissioners pay. However, avatar retextures will be placed at the end as they take the longest due to testing and texture edits.
Commission Subject Reference
My area of strength is anthropomorphic, feral, and creature-related commissions.
Do note that you are paying for my artistic vision in terms of color and placement; colors may be altered slightly to match my style or the overall look of the image.
Please keep my style in mind when commissioning me; if you think a specific commission is beyond my capabilities, then you should reconsider commissioning me.
Chibi art may have the artist slightly simplify your character if needed.
Delivery time
Drawn Commission may take a few days or a bit over a month, depending on the Queue, real-life events, character complexity, added elements, and or the rarely offered backgrounds.
Avatar Retextures may take 1 to 3 months, depending on the Queue, character complexity, added emissions, metallic, and/or small or large texture changes to attire or props to the avatar.
The time of delivery is based on active buyer responses to my inquiries; delays may arise if not.
Delay may arise depending on the following factors: order of commission, complexity, health, work, school, or family issues.
If delays arise, you will be notified.
If you choose a payment plan that spans the delivery time, the delay before completion will increase. (Payment plans are currently only available for orders of $100+ for returning clients)
In this case, I will work on your commission once I receive payment.

Examples of art pieces to guide me on the vibe or composition you are looking for are more than welcome; HOWEVER, don’t ask or expect me to copy them.

Asymmetrical textures require more time and will have an additional charge as I take extra effort to line up markings properly to the best of my abilities.
The client must have the requested model purchased to acquire a retexture, as stated by the model's creators.
Client will receive completed texture files to model
I can upload the models directly to your VRC account, but I can't make them compatible for Quest (don't have that figured out yet). All account login information will be cleared after client approval and once the model has been uploaded. Clients are encouraged to change their passwords afterwards.
Commission’s information
Please provide numerous useful references, characters, and poses; they’ll help me get closer to your desired result.
If you have any size, resolution, and/or color mode requirements, please inform me before I begin. If I have already created the file and worked on it, I might not be able to change it.
If you had a specific idea in mind, but I have to find references myself, an additional 15% charge of the final quote price will be added. (I will ask if you have any references before the fee is added)
You'll be notified if I add reference fees to the final quote price, so we can discuss it if needed.
A description of the commission is required; the more details, the better! You can also try to sketch your idea in paint: I’ll take everything! Event stick figure drawings! So you may easily avoid the reference fee if you give a sketch/doodle.
What you need to send me :
Type of commission (from what is currently opened/offered)
Reference sheet of the character/OC (flat colored, please)
Picture(s) of pose idea(s) (for non YCH)
Pictures of background(s) (ONLY if it's currently being offered)
Pictures you like the mood/colors of (this is only needed for shaded coms)
Description: (i.e, who, doing what, where, when, why, for what)
Any other things you can think of, or deem important(optional)
Customer agrees to the following Information below.
Payment & Refunds
I will ONLY start working on your commission after receiving full payment.
Currently, I only accept payment via KO-FI or PayPal.
If the commission amount is over $100, payment plans are welcome for returning customers only!
To have your commission featured in a stream, there is a fee of 15% based on the commission's price (Only one stream for each commission type. Please ask if a stream space for your requested type is available if interested)
The commissioner must pay for their commission up-front.
Additional charges may be added to your commission once the sketch has been edited/changed more than once or has been approved; those will be billed separately. It’s a $5 fee each after the first edit or initial approval.
If a commission needs to be canceled before work has been started, the artist will retain 15% of the payment as a convenience fee.
If a commission needs to be canceled after work has been started, or during the sketch stage, only a 50% refund can be issued, as time and labor have already been invested. (sketch/lineart will also be forfeited as it may be used for a YCH)
If your commission is in the color stage or otherwise completed, you may NOT receive a refund.
Breaking my Terms of Service does not make you eligible for a refund. (I retain the right to cancel your commission if it is not completed.)
The Artist reserves the right to cancel a commission.
Filing a chargeback will:
Forfeit your rights to use the artwork.
Place you on a public blacklist (with evidence).
Allow me to resell or reuse the artwork as I see fit.
Result in a formal complaint against you.
Copyright & Usage policy
I retain full commercial and distribution rights to any commissions I produce. I do not claim ownership or the rights to intellectual property or the character(s) depicted in commissions, unless they are my own.
My artwork may be used for personal display, such as profile pictures, banners, posting on social media with Credit, or printing for yourself, but may not be used for profit without prior agreement.
As the artist, I am permitted to do the following:
Post the art on any website/social media of my choosing.
Crop, edit, or alter the image for promotional use.
Make prints, digital portfolios, CDs, books, etc. of the artwork. (Image rights can be purchased for a fee)
Rights rates
Personal Rights are free of charge.
Commercial Rights, the prices will be: Streamer Commercial Use ($25 USD), and Merchandise Commercial Use ($60 USD)
The commissioner is allowed to:
Use the copyrighted artwork for personal use only, unless agreed otherwise.
Print the art for themselves, and claim the right to their character(s), but not the drawing itself.
Post the artwork in their personal galleries, with full credit given to the artist.
Should Copyright Infringement occur, the client’s rights to the art will be forfeited.
The following is considered Copyright infringement:
Reproducing, redistributing, or using the copyrighted artwork commercially without agreement.
Art commissioned turned into Non-Fungible Tokens(NFTs).
Reselling/making money off the art without the artist’s prior consent
Claiming credit for the creation of the artwork.
Removing any watermarks/signatures.
Altering the artwork without my, the artist's, consent.
Using any of my pieces to feed any AI generator or using it in an AI generator in any way
BASES
NO REFUNDS ON THESE DIGITAL GOODS
Once you have purchased my base, you are free to:
Create your own designs (for personal use or to make your own adoptables for sale).
Make reference sheets for pre-existing characters you already own.
Accept custom design commissions from those who wish to use this base for their own ideas.
Price your designs and commissions using my base as you see fit. I'm recommending and encouraging users to price accordingly based on the time spent on the designs you’ve created!
You’re allowed to make your edits as you see fit; there are no restrictions regarding this. You still must credit me for the original base.
I only sell PSD files of my bases, which are accessible on most art programs.
You absolutely CANNOT sell my bases or share them with others once you have purchased them. If someone wishes to use the base, they must buy it directly from my Gumroad.
No traces are allowed of my bases. If you find someone doing this, please contact me immediately so it can be addressed, and this person can be warned or promptly blocked/blacklisted.
Regarding marketing rights, absolutely no prints, media, or merchandise can have my name included or made use of. If you are caught doing this, you will be blacklisted.
When my base is used in any kind of way, you can credit me by linking back to my socials or store link, so other users can purchase! You can credit me by saying “Base by Inumaru Hokashi”.
