First and foremost, I think this is a great shot. I've been holding my reply b/c I've been too busy at work, and lazy when I get home. kudos on a great shot, and you can tell you've put a lot of your heart & time into the shot in post-productoin. great model, nice capture & execution, and all around great work.

The copyright issue, I'm thinking that's off. The "Old Navy" wording and look would not be protected by Copyright, but by Trademark. You won't get in trouble for the shirt he's wearing. if that were to hold up in court, pretty much every photographer out there would revolt. You would probably get in trouble if you used this image as advertisement and not giving them any revenue.

Movies & TV shows often will sell spots to companies as advertisement space: product placement. The names aren't covered / blurred so much to prevent them getting in trouble as it is not to endorse a certain product without getting compensation.

At the very least, and it wouldn't happen, you'd get in trouble for unauthorized Trademark Infringement, not Copyright infringement. :-P (but that wouldn't happen b/c you're not selling "Old Navy Prints.")

Not a problem, hope that helped. :) It's amazing to me how much mis-information there is about Copyright. It's enough to make you almost want to just make everything public domain... but then that sucks.

I'm loving the depth in his eyes. Are those really the natural color?

The white balance might be a tad bit off, though - It looks a bit too cold (hints at a bit too much blue) for the warmth that the rest of the picture portrays... But then again, that's just an initial crit. based on initial observation.

Also, while the face is situated in an ideal location for optimal attention, the left side (model's right) is a bit distracting due to the way it is cropped, detracting from the central focus of the piece, which is, in most cases (and seems to be here as well), the face. To alleviate this, I'd suggest trying either cropping tighter (to remove the distracting space where the background shows through), or wider (allowing the lines of the arm to complete through to the bottom edge)... But then again, I'm sure you already played around with both of those options.

Don't get me wrong, it's a wonderful, well-done piece, and the emotion portrayed in his facial expression is stunningly captured; I just think that the crop could have been better.

They're his natural color, but exagerated with photoshop. Now that you mention it, the white balance is a bit off. He hasn't ordered prints yet, so I'll write that on a stickey note to do.

I agree with the cropping as well. I beleive I did try cropping it, but it's hard to keep the composition good while remaining a 4x6 proportion.

All Very True.

Idea: To keep the proportions for printing (since dA seems so absurdly strict about it), you might try an off-set border/frame that you can personally clean up after receiving the print.

I agree, his eyes are definately the focal point of this photo. I really like the colours, and the angle. Compositonally, I think I'd crop a tiny bit more of the top of the photo off, to bring it in a little bit more, make it a little more intimate. Also, a little bit more of an expression might help to get more of his personality out. Other than that, wonderful photo. Great lighting.

true about the expression, he definantly has a different personality. I'm not sure about the cropping thought. Maybe a tiny bit, but then I'd loose my 4x6 size. =p lol

Having "Old Navy" in one of your images...Its illegal, unfortunately. Its called illegal advertizing, and unless you can prove they gave you permission, they see that name in your image, and they can sue you for copyright infringement and making a profit off a name...Thats all you need after the month you've had, lol. How'd that death threat thing go anyways?

hmm...? um...no. Clothing labels are public domain when theyre printed ON the clothing. Copyright infringement is the unauthorized use of copyrighted material, such as reproducing the copyrighted work, or to make derivative works that build upon it. If what you said was true, so many photographers would be fined.

Are you thinking about television/movies? because usually they blur name brands or use generic ones?
