Terms of Services (TOS):

TERMS OF SERVICE FOR DIGITAL ART COMMISSIONS

These Terms of Service (“TOS”) apply to all art commissions made by the artist and accepted by the client through message, email, form, payment, or any other means of contact.

1. General

By requesting a commission, the client agrees to these terms and conditions.

The artist reserves the right to refuse any commission for any reason.

All artworks are for the client’s personal use only unless commercial use is explicitly agreed upon in writing.

2. Commission Process

1. The client must provide:

- Clear visual references.

- A detailed description of the commission.

- Preferences regarding pose, clothing, background, expression, etc.

2. The artist will provide:

- An initial sketch for approval.

- Partial updates if deemed necessary.

- Final delivery in digital format.

3. Delivery time may vary depending on:

- Complexity of the artwork.

- Current commission queue.

- Personal or technical circumstances.

3. Payments

- Payment must be made 100% upfront.

- No work will begin until full payment has been received.

- Accepted payment methods will only be those provided by the artist.

- Prices may change without prior notice.

4. Refunds and Cancellations

- No refunds or chargebacks will be issued under any circumstances.

- Once the commission has been accepted and paid for, the work must be completed.

- The client agrees to these terms before making any payment.

5. Revisions and Changes

- The client may request as many changes as needed during the sketch stage.

- Sketches will be delivered in a rough or unfinished format to establish composition and general concepts.

- Once the sketch has been approved by the client, only 1 additional minor change will be allowed.

- Any further modifications after that will incur an extra fee.

- Additional fees must be paid before continuing the commission.

Examples of changes that may generate additional costs:

- Changing the entire pose.

- Changing the character.

- Redesigning the composition.

- Modifying already rendered or completed elements.

6. Copyright and Usage

The artist retains all copyright ownership of the created artwork.

The client may use the artwork for:

- Profile pictures.

- Personal posts.

- Wallpapers.

- Personal printing.

The client may NOT:

- Resell the artwork.

- Create NFTs using the artwork.

- Use it commercially without permission.

- Claim authorship.

- Modify the artwork without authorization.

7. Commercial Use

If the client wishes to use the artwork commercially:

- This must be discussed before starting the commission.

- An additional fee or commercial license will apply.

Commercial use includes:

- Merchandise.

- Advertising.

- Monetized content.

- Physical or digital products.

8. Publishing and Portfolio

The artist may only publish or display the commission on social media, portfolios, or promotional material with the client’s permission or prior notice.

9. Allowed Content

The artist accepts any type of content requested by the client.

10. Communication

The client must maintain clear and respectful communication.

Late responses from the client may delay delivery.

11. Final Delivery

The final artwork will be delivered digitally in:

- PNG

- JPG

- PDF

- Or another agreed-upon format.

Editable files (PSD, Clip Studio, etc.) are not included unless previously agreed upon.

12. Acceptance

By making payment or confirming the commission, the client declares that they have read and accepted these Terms of Service.
