FAQ #8: What are violations of the DeviantArt copyright policy?
this has been a question that has been brought up alot since the groups founding and i as co founder would like to make it a little more clear as to what is truly considered art theft on Deviantart so that way it will help watchers be able to spot art theft.
i will list off the biggest forms of art theft found on this site.
just as the name applies, it is a image normally most common are screen shots from anime (but it can be any image) where the person has simply colored over the original image to make the image their own. most often it will be hair, eyes and clothes. these are normally done by amateur artist and are done in MS paint and are very distinctive. these cases are one of the most numerous that we get but are also the easiest to prove as they have already provided us with the official screen shot.
2: Colored manga scans
this is a quickly growing fad among anime lovers. they take manga scans (most common have been naruto and bleach as of late) which can be found on sites such as MangaFox and color them.. many of which are extremely well done but are still considered theft because just as color overs they are simply coloring over the original artist work and claiming it all as their own.
3: Anime porn croppers
this has become a new huge thing, people taking screen shots and official pictures from Anime porno movies or computer games which is an art style similar to many actual artist on DA. they will take these images and cut out the girls and places them on new backgrounds to make them look original. these are harder to catch because many artist on DA have the same art style and color style.. but a simple look at a gallery can point out this type of thief.
4: popular art
this one is fairly simple and thankfully a slowly dying one here on DA. this is art work that is taken from very popular artist and the watermark either cropped off (or in some idiots cases left right on the picture) these are easy to spot as not only are they well known, but looking at the users gallery their art will greatly very from that image.
there has been a boom of artist posting screen-shots from movies and games. these are easy to tell as they will be obvious..this is considered theft because you are simply hitting a button and placing your copyright on it.
now for the list of what is NOT considered art theft.
these are art works of different photographic elements put together to create a new picture, this is a tricky area because it can be considered theft if taken from a none stock image. but most are alright if taken from Free to use stock images and are properly credited.
Artist on DA have become huge on Commissioning big named artist. this is art work that is drawn by an artist for money. most of the time it is OC's.
artist after receiving commissions tend to show case them and will place them up in their galleries. this is NOT art theft as no matter how much the original artist complains (some do.. most dont) if it was an OC work, the artist can post the image in their gallery since they are the copyrighted owner of that char. they paid the other artist to draw it for them.. giving the artist permission to take the char and draw it in their own style. while the commission artist has copyright to the art work.. the OC's creator is the copyrighted owner of the char.
3: Free to color lineart
many new artist have jumped onto the bandwagon (like myself) of Free to use linearts here on DA. they are linearts where the artist have given full permission for people to color the works and post them on their DA. you always want to check the lineart to make sure it is a free to use as many do post linearts on the website but they do not give out the free permission.
